Again, a President picking a black woman to be a Justice on the Supreme Court wouldn’t necessarily be affirmative action. But a President saying that he’d only consider a black woman for the post certainly is.

Her being suitable for the job is no higher than the third box ticked off. Is she black, and is she a woman are the first two. Her possibly being the best qualified is but a tertiary consideration.

They want to tell themselves is that a black woman is smart and accomplished enough to be on the SCOTUS. I have no doubt that there are black women out there that are. But you don’t make a pledge to put one on the bench and say she was selected from all possible candidates. That simply isn’t true.
