Hillary Clinton Campaign Attorney Moves To Dismiss Durham Investigation Case

Attorneys for Hillary Clinton’s presidential campaign lawyer filed a motion Thursday to dismiss special counsel John Durham’s case against him, calling the matter “extraordinary prosecutorial overreach.”

The lawyer, Michael Sussmann, was charged last year in Durham’s Trump-Russia investigation after he was accused of lying to an FBI agent when he told the bureau he wasn’t advising Clinton’s 2016 presidential campaign.

In the motion to dismiss, Sussmann’s legal team said he did not make false statements to the FBI — and argued that prosecutors were pursuing him on a technicality.

His lawyers argued that Sussmann voluntarily met with FBI agents in September 2016 to “pass along information that raised national security concerns.”

Sussmann had raised concerns with the FBI about purported ties between the Trump Organization and Moscow’s Alfa-Bank. Further review suggested the supposed digital fingerprints were likely the result of junk email.

“He met with the FBI, in other words, to provide a tip. There is no allegation in the indictment that the tip he provided was false. And there is no allegation that he believed that the tip he provided was false,” the motion says.

“Rather, Mr. Sussmann has been charged with making a false statement about an entirely ancillary matter — about who his client may have been when he met with the FBI — which is a fact that even the special counsel’s own indictment fails to allege had any effect on the FBI’s decision to open an investigation.

“Allowing this case to go forward would risk criminalizing ordinary conduct, raise First Amendment concerns, dissuade honest citizens from coming forward with tips, and chill the advocacy of lawyers who interact with the government.”

What are some other words for technicality? Constitution. Statute. Something that doesn’t go my way.

Of course a Rat Party appointee will grant the motion.And then it goes up the ladder until the whole thing is either dropped or everyone gets a Presidential pardon.

Any judge who dismisses this needs to be investigated. Corrupt judges shouldn’t get a pass.

Guess it depends on the meaning of wasn’t advising Clinton’s 2016 presidential campaign. He worked for the law firm that was advising Clinton, but he only advised his reporting supervisor, who then advised Clinton.......

See how that works... 2 degrees of separation!

This is an Officer of the Court, Why in the Hell does anyone that took an Oath to Uphold, Defend, Enforce or Protect the Laws or the Constitution EVER DESERVE BAIL?? A violation Of Any such Oath should be a NO BAIL Offense with a Mandatory 20 Year Sentence Enhancement

The judge handling this is said to be well-connected in Democrat circles. I'll be more surprised if this isn't dismissed.
