Judges in Louisiana, Utah issue temporary order stopping immediate ban on abortion, 'trigger laws'

A similar ruling was issued Monday in Louisiana, another state with an abortion "trigger law."

udge in Utah has granted a restraining order that will block for 14 days the state's abortion "trigger law."

Judge Andrew Stone of the 3rd District granted Planned Parenthood and the American Civil Liberties Union of Utah's request for a temporary injunction following an emergency hearing Monday.

Utah's abortion trigger law was passed in 2020 and was contingent upon Roe v. Wade being overturned by the Supreme Court, which the court did Friday.

The law bans abortions in the state with exceptions for rape or incest, the health and safety of the mother, or fetal viability.

Also on Monday, a judge in Louisiana, which also has an abortion trigger law, issued a similar ruling.

About a dozen other U.S. states have also passed trigger laws similar to Louisiana and Utah's.

In Utah, Judge Stone said in making the decision: "The immediate effects that will occur outweigh any policy interest of the state in stopping abortions immediately. Doctors here are threatened with felonies. Affected women are deprived of safe, local medical treatments to terminate pregnancies."

The office for Utah GOP Gov. Spencer Cox said the governor won't comment for now on the litigation but will watch carefully as the legal process unfurls.

The judge is out of order. He does NOT have the power to overturn the USSC decision or the laws of the state...not even for a moment.

Amazing Planned Parenthood is suing to protect 3% of its business..

Maybe the 97% is baby parts from the 3%..

The pro life folks should start noisy, but peaceful protests at their homes. It’s the democratic process in action, as we all learned in the last few weeks.

Democrats were quick to accuse those in SCOTUS of being ‘activist’ judges, but these in the states stopping the ‘trigger’ laws are the real activist judges. What in current laws or in the state or U.S. constitution are they using to justify their blocking of the new state laws? I guess when it comes to activist judges, it’s okay when they rule for the liberal side of things.

These “judges” are despots, nothing less. They cite zero law or long-standing legal principle, but merely their personal opinion that allowing laws already passed by the governing legislative body would be too inconvenient for some people. That would be like striking down a speed limit because Joe is always running late for work and therefore a lower speed limit would make Joe’s mornings difficult.

The legislatures in question should tell these “judges” to go to hell and ignore their empty proclamations.

It is not just the doctors that must be charged with felonies but also the clinic workers, nurses, the woman who seeks the abortion and anyone who is aware of an abortion occurring.

So, do these judges replace legislators, the voice of the people? Hopefully their rulings are overruled as political instead of legally based.
