(CNN)In a setback for Florida Gov. Ron DeSantis and Republican lawmakers, a Florida judge has ruled that a new state law banning abortions at 15 weeks is unconstitutional and he intends to block it from taking effect on Friday. In a verbal ruling on Thursday, Second Judicial Circuit Court Judge John Cooper said he would be issuing a temporary statewide injunction that will go into effect once he signs the written order in the challenge brought by some Florida abortion providers. The decision is a short-term victory for abortion rights advocates in Florida and it comes a week after the US Supreme Court overturned Roe v. Wade and eliminated a constitutional right that had existed for half a century. For the time being, abortion in Florida will remain legal until 24 weeks into a pregnancy, making the state one of the most permissive in the south.
Christina Pushaw, a spokeswoman for DeSantis, told CNN in a statement that the state intends to appeal the ruling.
"While we are disappointed with today's ruling, we know that the pro-life HB 5 will ultimately withstand all legal challenges," Pushaw said.

And where is abortion mentioned in the Constitution, oh learned liberal judge?
The left will resist forever.
24 ok, 15 not ok. Sounds like activism from the bench.
Nowhere!!!! Just shows how dumb those lefties really are.
On what legal and rational grounds is it unconstitutional, “judge” other than “it hurts my fee fees”
Impeach the Justices.
Isn’t that the truth? It never ends.
Remember back when the nation was somewhat at peace with truly rare abortion before R v W and we had a somewhat consistent national moral compass?
This is ruling patently unsupportable since the Supreme Court has just ruled that the State Legislature is the responsible party and that the Constitution has no abortion mandate.
How many delusional prima donnas can one Nation support in it’s judicial system? Should there be no penalty for illegitimate rulings?
This is a state court judge and likely interpreting the Florida Constitution. I am fairly sure this gets overturned at the Florida Supreme Court.
This indicates that Judge Cooper - and just who appointed him remains unknown right now after searching various places - but clearly Cooper has been against DeSantis before!
This too shall pass after November’s elections.
When they have nothing they go with unconstitutional
You have to give them credit for that, the republicans always take the easy way and cave.
This was entirely predictable and we’ll probably see more of these desperate procedural ploys. We knew that the battle would shift to the States, so here we go. We just need to let it run it’s course up through the legal system. until all of their tactics are exhausted. It’s still a slog, not a sprint, but we have already won.
The country’s judiciary were brainwashed throughout their legal education and professional careers that abortion is not only the constitutional law of the land but is ethical and “a woman’s right”. Many of these judges cannot accept this new reality and will do all they can to ignore it and subvert it.
If he gets reversed again on this (probably will) the Florida legislature needs to impeach him. If activist judges have no fear, they will keep doing this forever.
Neah.
We’re already in half helicopter ride territory.
The US doesn’t need Trump or DeSantis. It needs Pinochet.
I’m pretty sure I saw Florida listed among the states with laws criminalizing abortion in the Dobbs decision. (In the section documenting that the 14th amendment was ratified by the same legislators who saw nothing wrong with criminalizing abortion and do so all throughout the states.) That law stood for decades if not generations before Roe. So it’s a safe bet this decision is bereft of sane reasoning.
