I agree with Turley that this was a horrible pardon/clemency by Trump, but DOJ is going after him just to poke Trump in the eye. It’s also a chance for the left to highlight Trump’s clemency to an undeserving scumbag. Garland might also go into Esformes path to clemency, donations, influence, etc. They are attacking Trump from as many directions as possible, and have unlimited resources.

Trump commuted the sentence of this guy, but there were other counts on which the jury deadlocked on which he was not convicted, and those can be retried. Because Trump only commuted the convictions, but didn't pardon the guy, it is perfectly legal to retry him on the counts for which Trump did not commute his sentence.
It’s certainly slimy. Once again I ask WHY? Why go after THIS guy again when they have the money & he’s been in prison. Is it JUST because Trump pardoned him? Or is he some secret billionaire that funds conservatives? I’d love to know.
He is being retried on 5 or 6 counts that the original jury hung on and they weren’t included in the clemency.
So it’s not double jeopardy or violating the clemency order. It’s just petty. The jury could hang up again because they are obviously the weakest part of the original trial.
I dunno either. But if the guy really is a slimeball, I don’t much care one way or the other.

Unless the jury was deadlocked on "the 6 counts he wasn't convicted on," he can't be tried again for those counts. That would be double jeopardy.
The DoJ either has to have a mistrial on those 6 counts, or they need to find new counts to try. If he was found not guilty (not "not convicted"), then those charges have been disposed of forever.
And to think that Garland was almost a Supreme Court Justice?

They are erasing everything President Trump did during his presidency. I honestly believe Pelosi is behind most of this, she was dead serious when she ripped up his State of the Union, when the Republicans allowed it to stand, it was a green light.
