You’re right. Unless Congress specifically addressed this issue and passed a law, these judges are blowing smoke out their butts and discovering penumbras that don’t exist. I’m not surprised, though, because leftist judges constantly ignore USSC rulings.
For example, the USSC had to rule twice that puddles are not navigable waterways when lower courts ruled they were.
