The real play here is to prove they SAW something they were not supposed to see (the government), not get it back. Once Trump’s team can prove the government SAW something they shouldn’t have the entire case will have to be dismissed, because of the principle that “if the evidential “tree” is tainted, so is its “fruit.”
And if that is the case, Trump has some pretty clever Attorneys working for him.

The passports set a stake in the ground as the FIB already seized something out of scope and had to return them.
If the surveillance tapes show other out of scope searching, will be difficult for FIB to claim de minimis “oops.”
The more this gets reviewed, the worse for the FIB.
