Aug 26 (Reuters) - A U.S. appeals court on Friday upheld a ban on smoking in federally subsidized public housing.
The D.C. Circuit Court of Appeals said the Department of Housing and Urban Development (HUD) properly enacted a 2016 rule requiring state and local public housing agencies to ban cigarettes, cigars and pipes inside housing units and indoor common areas, and outside within 25 feet of those spaces.
Six tenants and a smokers' rights group, the New York City Citizens Lobbying Against Smoker Harassment ("NYC Clash"), challenged the ban, known as the Smoke Free Rule.
They said it improperly invaded their privacy and violated due process by preventing them from engaging in lawful activity -- using tobacco -- inside the home.
But in Friday's 2-0 decision, Chief Judge Sri Srinivasan said HUD provided "considerable" evidence that the rule helped protect residents against the health risks of secondhand smoke, prevent fires and reduce property maintenance costs.
"The department adequately substantiated its rationales for the rule and did not act arbitrarily and capriciously in promulgating it," the judge wrote. ~snip

Btw almost everyone “takes the King’s money” one way or the other—even if they work for a subcontractor of a subcontractor of a subcontractor of a government contractor.
The King has almost everyone on the payroll directly or indirectly.
On my walks in San Francisco, I occasionally pass by public housing complexes. A near-permanent feature is the stench of marijuana smoke wafting from the open windows. If any sort of smoking ban is being enforced there, it’s apparently only applicable to tobacco.
Hey, as long as meth and pot smoking is still okay, all is hunky dory. 🤪
How is this not racist in the same way as the law outlawing menthol cigarettes?

Once your rights come from the government, they can be taken away by the government.
The goal of our dictators is that everyone will be beholden to the government for their housing, food, and health care, not just the “poor”. What they provide one day, they can take away the next, especially if they do not like your voting history.
People can cheer this decision, but what if the government next decides that only CNN or MSNBC can be played in government housing projects. After all, it’s for their health.

I cannot believe that this rule is being enforced. Any police or whatever that tries to enforce this will have guns and knives pulled on them. At least in some of the so called public housing for useless eaters. For the most part. They are living (scamming) off the government in a 1000 different ways.
