A Supreme Disgrace at the High Court | Opinion

Last spring, the American system of government suffered a grievous blow when someone leaked the draft Supreme Court opinion that would ultimately prevail in Dobbs v. Jackson Women's Health Organization, overturning the infamous Roe v. Wade abortion precedent.

The brazen act threatened the internal deliberative process on which the Court relies for its day-to-day functioning and spurred illegal protests outside the homes of justices. Those protests attempted to cow the justices into deciding Dobbs the way the pro-abortion mob wanted, culminating in an assassination plot against Justice Brett Kavanaugh. The damage done to the Court as an institution was incalculable, and perhaps irrevocable.

At the time, Chief Justice John Roberts called the leak a "singular and egregious breach" and a "betrayal of the confidences of the Court," and ordered an investigation into its provenance.

Many of us, myself included, predicted this very thing, Roberts being the CJ.

Either Roberts, Sotomayor, or Kagen leaked it. That’s why they didn’t “find” the leaker.

I have always questioned how Roberts became Chief Justice even though he had never served on the highest court. It stunk back then and he still stinks. I think they wanted to install someone they could control, someone who was compromised.

In plain English, the person responsible is someone whom is above the law in post-Constitutional Washington. Above the law for reasons of Party, Race, Seniority, Political beliefs or being related to a member of the nobility.

I think they know who leaked it , but for whatever reason , the powers that be do not want to make this public.

It could well have been one of the liberal justices who leaked it.

So probably what happened , is they decided to not release the results of the investigation into the leak.

We may learn decades from now who the leaker was, similar to how decades later we learn the identity of the deep throat character from Watergate.

There is a group of people at the Supreme Court who know who leaked it, but they aren’t talking for now.

One wonders what security training, experience, and associated staff SCOTUS Marshal Gail Curley has. Are key logs recorded for individual computers and workstations on which draft opinions are accessible? Are SOPs established for access to copying machines? Are chain of custody records kept on draft opinions? Do printed copies have coded identification marks embedded within the pages? Were lie detectors used in the questioning of staff and justices?

The Public Report indicates that there needs to be serious upgrades in SCOTUS document and IT security.

I think it is customary to appoint a Chief Justice as an outside replacement rather than as a promotion from within the existing justice pool. The Senate gets extra oversite scrutiny that way.

I most certainly could be mistaken on that point, however.

Look how fast and efficiently the Federal Government identified the peacefully protesting US citizens on January 6!

And indicted them and shipped them off to the gulag!

The US Federal Government is corrupt and rotten to the core. Ultimately it is the American People who are responsible. It is they who tolerate the defilement of this most sacred of all nations, the United States of America.

When this story first hit the news, some of us pointed out that the investigation would go nowhere because leaking the draft of a U.S. Supreme Court decision is not a crime.

The big indicator for this was when the investigation was led by the Supreme Court Police, and not the FBI. The FBI would only be involved if there was a suspicion that someone's computer had been hacked or the draft stolen in some other way.

The only "breach" that has occurred in this case is a breach of confidence among the Supreme Court justices and their staff. I honestly don't think that's a bad thing.

When they release the analysis of the lie detector tapes we will know for sure. Oh wait! No one was given a lie detector because all the justices and their clerks are totally honest. Sorry, I lost my head for a minute.

I believe one or more justices colluded to leak. Then the squishy ones were leveraged to rule in favor of striking down Roe when they normally would never have done so. They did it as one more plank in their “get Trump no matter the cost” efforts.

And abortions continue, unabated in most states. See Minnesota.

I think it was Roberts himself. I thought that the minute I saw it. Totally consistent with his efforts to neuter anything that might seem "controversial" on the court ("Controversial" to Roberts being anything not amenable to the left).

W didn't want Thomas in the position. I'd wager that his father considered Thomas his greatest disappointment. He didn't want a real conservative justice and clearly W didn't either, although he did well with Alito (2nd choice last minute hail mary substitution after Harriet Miers debacle)
