Indicting Trump Would Be Targeted Injustice

When I was coming of age in the 1950s Southern prosecutors would target civil rights workers and search for any possible violation of the law, no matter how technical. If they discovered or invented a violation, they would indict, prosecute, convict and sentence the target.

Often the violation would be of an obscure statute that had never before been deployed. To paraphrase the late Justice Robert Jackson, these anachronistic statutes and precedents lie around “like loaded weapons“ ready to be selectively enforced against political enemies.

That, precisely, is what we are now seeing with the Manhattan district attorney, Alvin Bragg, targeting the former president and current candidate, Donald Trump. Does anyone actually believe that if someone else were accused of paying hush money to avoid a sex scandal in the manner that Mr. Trump is suspected of doing, he would be prosecuted?

After spending months searching the criminal code for a law that Mr. Trump might be accused of violating, Mr. Bragg has apparently landed on a highly questionable campaign contribution provision that has never before been used in a comparable situation.

As Jackson also presciently observed: “With the law books filled with a great assortment of crimes, a prosecutor stands a fair chance of finding at least a technical violation of some act on the part of almost anyone.”

He added: “In such a case, it is not a question of discovering the commission of a crime and then looking for the man who has committed it, it is a question of picking the man and then searching the law books, or putting investigators to work, to pin some offense on him.”

So now Alan Dershowitz *and* Jonathan Turley,the two most respected Constitutional scholars in the country (and both democrats) are on record questioning the legitimacy of this move. But,OTOH,the gals at The View at waving their pom poms right now.

It is usually wiser to wait on events as opposed to emotionally reacting in anticipation of them. The latter often makes you look dumb when said event never happens in the first place.

I'm leaning towards this much ballyhooed "arrest" of Trump not happening at all.

The only Republican prosecutors you can find today are in suburban and rural counties. Imagine what would happen if Hunter were to be indicted for illegal financial transactions with the Red Chinese by a grand jury in Crested Butte County,Wyoming. That’s right...crickets. Or maybe derisive laughter from Chuck Todd and the editorial writers at the Amazon Compost.

Waiting for the indictment is too late. There is an ongoing biased, politically charged, corrupt, thumb-on-the-scales process that DeSantis should speak out about -- as others who aren't Trump supporters have. Not doing so will destroy DeSantis' chances at the polls. Trump supporters will sit on their hands if he's the choice in the general, and many of DeSantis' supporters -- myself included -- will be hesitant to support him if he can't at least speak out for fairness and blind justice.

What Trump did -- and I believe he did it -- was wrong. But for anyone who has followed Trump throughout his career, this behavior can't be a surprise to anyone. Paying this slut to go away isn't a crime in any real sense. People have paid people to go away for time immemorial.

DeSantis needs to step up and be a bigger man than Trump. He needs to denounce this process and call it out for what it is -- thorough corruption on the part of the left and the Democrat party. To not do so harms him, and tells us that he will not be the one to stand up to the Deep State and take decisive action to dismantle it...
