This wasn't "the government", it was specific individuals in the U.S. Air Force who failed to report the shooter's criminal history to civilian authorities.

The taxpayers shouldn't be on the hook for this. The officers who failed and their superiors should be billed for it and the money paid out of a fund paid for by reducing the pay for officers in the AFSCs that were responsible for reporting this to remind them of the consequences of failing to do their jobs.

He did something, while in the Air Force that the military didn't enter into the system.

It would have prevented him from, legally, buying a gun.

The killer was, eventually, stopped by an armed citizen with an AR15.

U.S. District Judge Xavier Rodriguez found the government 60 percent responsible for the attack, after the Air Force failed to report Kelley’s criminal history to the FBI.

“[T]he evidence shows that — had the Government done its job and properly reported Kelley’s information into the background check system — it is more likely than not that Kelley would have been deterred from carrying out the Church shooting,” Rodriguez said in the July 2021 ruling.


They failed to follow their own rules in reporting behavior that would have shown in the background check and prevented him from buying the guns he used to commit mass murder.

Did the government argue that background checks would simply force him to buy black market guns and not prevent the event?

Seems like the shooter fell through the cracks buying a gun if I remember correctly The Feds knew he was a nut job

If the USAF failed to report to the FBI as required by law then yes the government bears some responsibility here.

The Hill leaves out pretty much all of the day’s events. The below is to the best of my recollection. Please correct if I’m off track on something.

Well across the street from the church was a residence and the owner was a man that was a gun safety instructor. He heard the shooting, grabbed his AR-15 and ran out the door towards the church. He got to church area about the same time as the gunman was getting into his pickup for the getaway. The Samaritan put several rounds into the drivers door side as the gunman drove away.

The Samaritan ran back to his house for his pickup and gave chase. This ended up on a highway at very high speed. He was on the phone with 911 throughout the chase. Law enforcement was closing in but not caught up.

Somewhere along the line. The Samaritan realized that he didn’t know if had any rounds left. He hadn’t grabbed a spare magazine and he knew the mag in the rifle was not full when had run from his house. The Samaritan kept on the chase.

After some miles, still on the phone with 911, the gunman exited the highway and rolled to a stop in the grass. The Samaritan grabbed his rifle not knowing if he had rounds remaining and approached the gunman’s pickup. The gunman was passed out or dead. It turned dead IIRC. Multiple AR rounds at the church had penetrated the door and hit the gunman. He had bled out on the highway chase.

Cops finally caught up.
