Tennesse House Republicans Clash With Gov. Lee on Gun Confiscation Orders

Republicans in the Tennessee House of Representatives are signaling defiance of their fellow Republican, Gov. Bill Lee, after he proposed legislation to allow law enforcement officers to temporarily seize firearms from persons if a court agrees that they pose a threat of harm to themselves or others.

Tennessee policymakers have considered a number of new laws since the March 27 Covenant School Shooting, in which an assailant killed three children and three employees at a private Christian school in Nashville. In the days after the shooting, Lee proposed a revised state budget that included additional spending for school security. In more recent days, Lee has also called for legislation that would allow police and courts to intervene to remove firearms from persons believed to pose a risk to themselves or others.

On Wednesday, Lee’s office shared draft legislation (pdf) that would establish a so-called “temporary mental health order of protection.” This order would allow law enforcement officers and agencies to petition a court to temporarily seize a person’s firearms if the officials could convince the court that the person had made threats or attempts of serious bodily harm to themselves or others, or “places another in reasonable fear of violent behavior and serious physical harm.”

The language proposed in Lee’s draft legislation is similar to laws adopted in other states that allow concerned parties to petition courts to remove a person’s firearms. These laws are often referred to as extreme risk protective orders (ERPOs), gun violence restraining orders (GVROs), or similar terms, but are most often referred to colloquially by both critics and proponents as “Red Flag” laws.

In a video message posted on Twitter, Lee said “we all agree that dangerous, unstable individuals who intend to harm themselves or others should not have access to weapons. And that should be done in a way that requires due process and a high burden of proof, supports law enforcement and punishes false reporting, enhances mental health support, and preserves the Second Amendment for law-abiding citizens.”

The governor said he had crafted his proposed legislation after working with Tennessee lawmakers, including “constitutionally minded, second amendment-protecting members” of the state legislature.

If they are dangerous enough to take their guns away, then they are crazy enough to be involuntarily committed to a mental hospital.

Taking away the guns doesn’t make them any less dangerous, it just makes them change their methods.

Red Flag laws are constitutional violations, period. Trials without the subject being notified - it’s messed up. Here in IL, someone who knows who I am can hear me make an off-color joke and my guns can be ordered taken from me without my knowledge, and I have to prove I’m responsible enough in order to get them back. In our court system? Try hundreds of thousands of dollars and a decade of hearings.

Excellent point and one that almost every Red Flag law ignores completely.

But what few know (and those who do know choose to ignore) is that most Danger To Others threats never materialize into action. And, for most people placed on a hold, the danger resolves within 72 hours or less, and does not reoccur.

Millions own or have access to firearms and other weapons. It is reasonable to think that a very large number have at some time gotten angry, or inebriated, or enraged over some slight or offense at an identifiable group or individual and never acted on those thoughts and feelings.

Kemp (GA), Gianforte (MT), Pillen (NE), Sununu (NH), DeWine (OH), Noem (SD), Abbot (TX), Youngkin (VA), Lee (TN)...
However, better than the card-carrying-communist alternatives...

No seemingly reasonable law has ever been created that wasn’t used by American governments at every level to grab, increase, maintain, and enforce governments power over the serfs...

Didn't you have a little help, Governor Lee?

Brent Leatherwood — president of the Ethics and Religious Liberty Commission within the Southern Baptist Convention — wrote an open letter to Gov. Bill Lee, House Speaker Cameron Sexton and every member of the legislature about his stance. He has three children who attend The Covenant School. Not only does he deal with the SBC, Leatherwood previously worked in politics, where he was the executive director of the Tennessee Republican Party.

Leatherwood said he supported Lee's efforts, and he reminded the assembly that Southern Baptists comprise more than one-fifth of the state's population.

So The SBC supports red flag laws? I'll be darned.

Just what is my ‘mental health’ when I am sleeping?

Maybe it could be anything.

So - toss a flash-bang through my bedroom window. And I freak out.

My ‘mental health’ was suspicious and we take my guns, lock me up, and impose ‘threats to federal govt’ - and you may never find me again.
