Court denies Massachusetts 7th grader free speech request following legal battle over 'two genders' shirt

Liam Morrison, 12, is suing Nichols Middle School school officials for violating his First Amendment rights

One 12-year-old's lawsuit against his school for allegedly violating his First Amendment rights after he was prohibited from wearing a shirt that said "There are only two genders" hits a speed bump after a District Court hearing.

"We were asking for an immediate order so that he could express himself for the rest of the school year," Alliance Defending Freedom (ADF) legal counsel Logan Spena told Fox News Digital. "Liam’s suing for the right to do what every other student in his school currently has the right to do, which is respectfully express their own view on a matter of enormous public concern. What is the relationship between sex and gender?"

Attorneys with Alliance Defending Freedom (ADF) and Massachusetts Family Institute (MFI) filed a federal lawsuit last month against Nichols Middle School (NMS) officials and the town of Middleborough, Massachusetts on behalf of Liam Morrison, a 7th grader who was forbidden to wear a t-shirt to school that reads "There are only two genders."

The school officials and town of Middleborough are arguing they can censor any speech that they think will be offensive to other students, Spena said.

"They claim that because Liam's message is not inclusive, they can exclude it," he said. "What they don't account for is how does their own speech and all the other speech they already permit impact Liam? It completely excludes him. But for some reason that doesn't seem to count."

So it's OK to wear T's advocating gayness but not T's for science and common sense. Before Obama this was not even an issue.

Censoring anything that is “offensive” is how they control all language. Eventually the fact that the world is a sphere will be censored because it is offensive. It will get to that and really, it is already there with men demanding to be called women.

[First Amendment]

Oh, that notion existed under the old America; the one before the Liberal World Order.

All schools should require uniforms for all students if they claim to have the right to allow one child to wear clothing offensive to others but not the next child.

Just the words alone makes any sane individual look upon this with a skeptical brow!!

7th grader... 2 genders... school... High Court...

There is absolutely no way back from this other than the sudden disappearance of the decision makers. It may take a few waves of disappearing decision makers, but eventually the decision makers will get it and normalcy should prevail...

Yes. We’re not going to vote our way out of this. They won’t let us.

ANOTHER REASON TO HOMESCHOOL

This ping list is for the other articles of interest to homeschoolers about education and public school. This can occasionally be a fairly high volume list. Articles pinged to the Another Reason to Homeschool List will be given the keyword of ARTH. (If I remember. If I forget, please feel free to add it yourself)

The main Homeschool Ping List handles the homeschool-specific articles. I hold both the Homeschool Ping List and the Another Reason to Homeschool Ping list. Please freepmail me to let me know if you would like to be added to or removed from either list, or both.

So….a t-shirt that says, “Hitler was a great guy” IS inclusive and OK, but “Hitler was evil” is exclusive and would NOT be OK?

The court denied an injunction, it didn’t rule the kid isn’t right, just that he had to wait for his day in court.

Personally, I see this as the court simply playing games, and just kicking the can.

Honestly as far as I’m concerned, schools should have uniforms, just like parochial schools, then all this nonsense goes away. Everyone wheres the uniform, period. YOu can wear what you want on your own time, but in school. you are hear to learn, wear the uniform, and done.

So simple, buy 2-3 uniforms at the beginning of the year, and you are good all year.

Not social BS about having to wear trendy clothes, or being ostracized because you aren’t etc etc etc.. You get rid of a good bit of the petty inane BS inside schools if you just require uniforms.

He almost certainly will win once he gets his day in court, this was just a request for an injunction until then that was denied.

“There are only two genders”

It all depends on the language the shirt is referring to, doesn’t it?
