This is a criminal matter. The prosecution will have the burden of showing beyond a reasonable doubt, not by a preponderance of the evidence, that each element of each charge has been satisfied under that standard of proof. To the extent, if any, that the charges are based on Trump’s alleged disclosure of classified material in the audiotaped meeting, the prosecution will have a problem. Trump will testify that the material he held in his hand was not classified; and unless the other participants in that meeting testify to the contrary, the audiotape will be the only countervailing evidence. Under those circumstances, if I were a juror, I would find that the prosecution had failed to satisfy its burden of proof.
His explanation is exactly what I thought when I read the quotes of what he said. I believe he was also making fun of Hillary Clinton.
And to make any of this a crime is outlandish.

He is not accused of or charged with disclosing classified material at the meeting that was recorded. This tape will only be used to attempt to establish a pattern of behavior involving mishandling classified documents. That and of course to convict him in the court of public opinion.
The people in the meeting are still available to say what kind of paper he was flipping through, newspapers, paper documents, whatever. One Guy wonders whether either side is doing depositions of those people?
Isn’t the tape hearsay though, being that the people whose voices are heard are all presumably available to testify?

What Trump said on the tape is an exception to hearsay: admission against self-interest.

Yep. Everybody will believe it. Trump is a salesman and engages in the standard salesman tactics. Since they couldn’t identify exactly which supposedly classified documents he was supposedly discussing, let them prove it.

Oh I disagree. I think just about any jury in South Florida will readily buy that Trump was just holding up some random papers as a rhetorical flourish and that the papers weren’t really classified. If the DOJ wants to claim they really were classified documents then they’ll need to identify specifically which ones.

Is it really the greatest sale ever? No. Almost certainly not. It may well be a good sale. The prices may be quite low in comparison to anything else, but its not the greatest ever. Does that mean the salesman was "lying"? Not really. Its just sales. They exaggerate things. We all understand that. It doesn't mean that there's no sale going on at all....ie that there is no factual basis for what he's saying....only that he tends to exaggerate when he speaks.
He should be taken seriously, but not literally.
There are 27 codified exceptions to the Hearsay rule. They could get it in under one of them - for example statement against interest.
It’s irrelevant if he was waving top secret documents. It’s an audio recording not a video so there’s no proof of what he was holding up if anything.

At the end of the day Trump does not have to prove himself innocent. His guilt musto be proven by more that than a preponderance of evidence as in a civil suit, it must be proven beyond a reasonable doubt. The defence has no specific “plans”, no such “memo” exists. It may have 84 nameless witnesses and only heaven knows how many paid informants - to what? That Trump was speaking rhetorically? That orange man bad? I am truly suprised that they didn’t come up with a 1,397 counts in the indictment. C’mon Smiffy, you ain’t even trying.

I assume “toying” is bravado-speak for “desperately trying to bullshit his way out of another self-inflicted disaster.”
