If all it took was a majority of jurors in a sixth amendment trial, nobody would ever be found not guilty.

“We have to abide by it.”

They ignore EVERYTHING else in the Constitution, but they revere this one Civil War clause in the 14th Amendment.

They disgust me. They are unfit for office, not Trump.

So does "officer of the United States" apply only to commissioned officers in the US military (initially aimed at people like Robert E. Lee)?

Unfortunately Sec. 3 when it speaks of individuals who may have "engaged in insurrection or rebellion" doesn't say how that is determined--does the person have to be found guilty in a court of law or is it enough for a Congressional committee (consisting entirely of that person's political enemies) to assert the person's guilt? Of course in the Reconstruction era it was obvious who was meant.

This is why they spouted insurrection over and over when they knew it wasn’t. This was the plan. Was any of them dumb enough to leave a paper trail.

True, but he's a RAT, so they go by different rules, and if they don't like the last rule they made up, they'll simply change that one, and create another one that suits their needs.

This is what they’re going to use as their Kristallnacht. They’ve reached a critical mass in the courts, and they’re going to start throwing arcane stuff in the Constitution to finish the job. They’re going to turn the meaning of the BoR on its ear, and they’ll do it completely “legally.”

An officer under the United States is anyone appointed to a Federal office either military or civilian. Elected officials cannot be officers under the United States. Electors are not officers under the United States. That is why Section 3 of Article 14 specifically lists Senators, Representatives and Electors since they are not covered by officers under the United States. President was not considered an Office under the United States (see McKnight 1878) so it is not covered under that part of the section. It is also not mentioned in the rest of the section therefore it cannot apply to the President (or Vice President).

Separation of powers-——
Congress may have labeled Trump an insurrectionist
but no court of law ever convicted him of being an insurrectionist.

I agree that Section 3 is murky as to how to determine who has engaged in insurrection or rebellion. At the time it was written it was pretty obvious who it was written for (anyone enlisted in the Confederate Army & Navy and anyone who had been part of the Confederate government or part of the government of any of the seceded states).

Today it defies logic and fairness that someone could be declared an insurrectionist without a trial. To let that simple unproved accusation invalidate them from Federal service or office would allow a dishonest majority to simply label all their political foes as insurrectionists thus eliminating the competition and seizing power apart from the democratic process. It certainly is not what the founders would have wanted and probably not what the authors of the original amendment intended in 1866.

Also embodied in the 14th Amendment is that little thing called due process. I guess fascist Raskin forgot that fact. Raskin also “forgot” to report his wife's $1.5 million dollar stock transactions and was hit with an ethics complaint.

"Majority" (RINO)

RINOS voted Guilty: burr, cassidy, collins, murkowski, sasse, romney, toomey.

And Manchin (who might change from D to RINO) of course.

Should be a category worse than RINO. Even Cornyn and McConnel voted Not Guilty.

An officer under the United States is anyone appointed to a Federal office either military or civilian. Elected officials cannot be officers under the United States.

Definition: Officer - One who holds an office of authority or trust in an organization, such as a corporation or government.

Are you sure about this? The word "office" is used throughout the Constitution, especially in Article II.

Article II Section 1

The executive Power shall be vested in a President of the United States of America. He shall hold his Office during the Term of four Years, and, together with the Vice-President chosen for the same Term...

No person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President; neither shall any Person be eligible to that Office who shall not have attained to the Age of thirty-five Years, and been fourteen Years a Resident within the United States...

Before he enter on the Execution of his Office, he shall take the following Oath or Affirmation:

"I do solemnly swear (or affirm) that I will faithfully execute the Office of President of the United States, and will to the best of my Ability, preserve, protect and defend the Constitution of the United States."

Here's more...

Article I Section 3:

The Senate shall chuse their other Officers, and also a President pro tempore, in the absence of the Vice President, or when he shall exercise the Office of President of the United States.
I think limiting the use of the word "Officer" to only military positions is not the intent of the Constitution.
