Representative Jamie Raskin (D-MD) said on Sunday on CNN’s “State of the Union” that Donald Trump was disqualified from holding office because a majority of senators voted to convict the former president on an impeachment charge of inciting an insurrection at the U.S. Capitol.
Raskin said, “We’ve been saying all along that section 3 of the 14th Amendment presents a clear and unequivocal statement that anyone who has sworn an oath of office, and not just a president but members of Congress and others who hold federal office, who engage in insurrection or rebellion, having sworn an oath to uphold the Constitution against enemies foreign and domestic, could never serve again in federal or state officve. This is added after the Civil War as a general constitutional principle. We have to abide by it.”

I do believe Biden made multiple public comments in the attempted COUP of Donald J Trump. has he been REMOVED from office yet? What about the demonrats in Congress that did so? have they resigned or been removed yet?

Yup. “Majority of the Senate” for impeachment is just a made up benchmark that has no Constitutional validity. You might as well say “a majority of journalism majors from the Columbia University school of journalism”.

Section 3 of the 14th Amendment does not cover the President. The position is purposefully omitted from that section which mentions only “ELECTORS OF THE PRESIDENT”. Furthermore the President has never been considered “AN OFFICE UNDER THE UNITED STATES” (see David McKnight, The Electoral System of the United States, 1878).
Federal elected officials in the Executive and Legislative branches are not offices under the United States and that is why Senators and Representatives are distinctly and separately mentioned in Section 3, Article 14.

Every statement Trump made was legal at the time he made it.
Just because evil people misused those statements is insufficient to bar Trump from office.
The symbol for the Democratic Party is a jackass for good reason. The US Senate is loaded with Democratic ‘jackasses’.
I can’t believe I used to live in that grotesque embarrassment’s district. His father, Marcus Raskin, was a Communist, and Jamie seems determined to follow in his footsteps.
The country is so pissed off about what’s happening, I wouldn’t be surprised that if the GOP didn’t let him run, and he ran as an Independent, Trump would still win the election.
