DOJ loses on appeal in trying to block Trump deposition

The D.C. Appeals Court ruled Friday that former President Trump can be deposed in suits against the FBI brought by former agents Peter Strzok and Lisa Page.

The Department of Justice appealed a ruling from a lower court in July, which came to the same conclusion.

Strzok is suing the bureau for wrongful termination and Page is suing for invasion of privacy after the pair were embroiled in a political scandal due to work on the bureau’s investigation into Trump’s ties to Russia in 2018.

Text messages became public in which the pair spoke about how they personally disliked Trump, causing concern that the entire investigation was biased, later resulting in Page resigning and Strzok being fired.

“Only the most extraordinary of circumstances would justify allowing a plaintiff to depose a former high-level official about actions he took in the course of his official duties. This case falls far short of that standard,” DOJ attorneys argued in their appeal.

Could be really big one and looks like a win for Pres. Trump in the ongoing litigation, particularly with the DOJ, Biden, Ga., and New York State. A major issue in all of the cases is going to be the extent to which Biden himself was involved in directing them and in making decisions that violated President' basic due process rights, the effect any of which violation could be to get much of the litigation knocked out on due process grounds. Biden is an essential fact witness in all of these cases. Now he has been declared an allowable fact witness in the case cases brought by Page and Strzok, creating an excellent president for calling him in the current Trump cases. Buy the popcorn, because these things are not going to move anywhere is fast as DOJ wants to.

Where does your linked article say anything about Biden having to testify? If I had a reach like that, I wouldn’t have to bend down to tie my shoes.

Looks like Jackson made a classic beginning chess player’s stupid move, by exposing the queen, (in this case Biden because he’s the one who will be attacked, rather than Harris) by making an bone stupid attack, producing that exposure. I refer to Amy Berman Jackson, because she is a very radical leftist who ruled for Bill Clinton in the infamous socks drawer case and is has now ruled for Strxok and Page against Truck. However, that ruling and the DC circuit’s affirmation of it are now going to be cited in support of every motion to allow Biden and his closest accomplices to be deposed in each of the Trump cases.

Doesn’t have to; all it is to do is discuss the rules that apply and don’t to requiring a president to give a deposition and thereafter testify. Right here Trump was accused of masterminding the removal of the two plaintiffs, the same thing it’s clear Biden did in masterminding the anti-Trump litigation. Just because that Biden isn’t mentioned doesn’t make any difference; the important thing is that the “president” was mentioned.

The ruling said that Trump had to be deposed...so ostensibly not a win.

It could be a win in a bigger sense should the precedence bet turned around on politicians being sued by people that were actually wronged by them...which is why I suspect the DOJ was actually opposing having Trump deposed (its not like they care about being fair to Trump or respecting his rights obviously).

Love the "invasion of privacy" when he was using his personal email and personal phone for FBI business and they showed his wife had access to his phone which is how she discovered the affair with Page.

Strzok & Page got off easily. This smacks of law fare as part of the "Get Trump" campaign.

All the DOJ has to do is pay them off to settle their cases, and there will be no depositions. And now, they probably will.

It could be a win. Trump has specific knowledge of this as he was the target of their investigation of him under pretexts that they knew, or had to know, was a fabrication.

Whether Trump had anything to do with their dismissals may be a side-issue. It looks more to me like the FBI wanted to scapegoat someone and these two patsies, at least one of whom was cheating on the spouse, fit the bill. They left a paper trail and engaged in conduct that looks bad for the FBI.

I don’t know the nature of their claims, but if I were them I’d be saying “Yes, I hated Trump. But I didn’t know the case was bogus and concocted in the Oval Office with Susan Rice and FBI Director and the DNC, I was just doing my job following the leads my DOJ superiors told me to follow and they used my dislike of Trump in the hopes of using me as the fall guy if their plot crumbled - they are the ones at fault and they fired me wrongfully in order to create the appearances that they “fixed the problem” when in reality they are and were the problem”.

Thus, my conclusion, they will now get a settlement.

From what I can remember (and it has been a while so I may be forgetting some details), the obvious bias in their investigation of Trump and “Russian collusion” SHOULD have resulted in their firing. The evidence of such bias is clearly set out in the texts. Especially the one about the “insurance” to make sure he is not elected.

Also, if they had been fired at Trump’s direction, and not their departmental supervisors, evidence of such would have been shouted far and wide with front page news articles at WaPo and NYTs. Once the text messages became public the DOJ/FBI had no choice but to fire them in order to make the issue of their bias go away. Firing them was part of the cover-up. Who made that decision?

The precedents being set as many laws, rules, and regulations are being tossed aside due to what I call “the Trump exception” is going to come back to bite the leftists in the keister.

It's not that they don't want Trump deposed, it's that they do not want Trump, who was the president at the time, deposed because they're concerned about Biden, who is now the president, being deposed in any of the four cases that are running against Trump. That's why this is a good decision for Trump because it opens the opportunity to depose Biden in each of the current, four bogus cases.

IMHO the DOJ what it did because they were trying to protect Biden. They did not want this decision because the decision essentially says a president, any president, can, under certain circumstances, be deposed as a fact witness. Biden is a blatant fact witness in all of the criminal prosecutions that had been brought against Trump. Now that this decision exists they may have legal open season on Biden. Hence, this could be a big win for Trump.
