GOP lawyer with ties to three Trump rivals enters 14th Amendment fray

A Republican election lawyer with ties to three of former president Donald Trump’s GOP primary opponents has joined a crowded field of individuals and groups exploring whether the former president can be kept off the ballot for his role in fomenting the violent attack on the U.S. Capitol on Jan. 6, 2021.

Jason Torchinsky, a partner with the Virginia law firm Holtzman Vogel, has in recent days initiated conversations about the idea of trying to disqualify Trump with a range of figures, including a Democratic secretary of state, fellow election lawyers and a retired federal judge who has helped lead the push to question Trump’s eligibility, according to multiple people familiar with the calls, who spoke on the condition of anonymity to discuss private conversations.

The lawyer’s involvement reflects the latest escalation in an emerging legal fight over a once-obscure provision of the Constitution. The tussle has produced surprising alliances, and analysts say it will probably end with a ruling on Trump’s eligibility from the Supreme Court.

This article offers a good summary of the many efforts around the US to remove Trump from the ballot if he gets the nomination. Including by Republican Party affiliated attorneys at Holtzman Vogel. Is the Republican party behind this?

I think they are wrong and doomed. If Trump somehow becomes the Republican nominee, let the people vote.

The spreading effort should be concerning to voters. All it will take is one or two states to remove Trump and he might not be able to win overall. Democrats might not have to cheat to win.

Trump is apparently writing letters, such as to the New Hampshire Secretary of State "urging him not to remove Trump from the ballot." That he is even writing letters makes clear this is real and a threat to his campaign.

This needs to be settled by the Supreme Court next week. Otherwise it is the worst kind of law fare because Trump is having to fight 15 or 20 battles at once.

This guy absolutely is a GOP lawyer, and he did most of the work on the florida redistricting for DeSantis.

Records obtained by American Oversight and cited by ProPublica include an email from Jan. 5 inviting top officials in DeSantis’ office to join a “Florida Redistricting Kick-off Call” with out-of-state operatives who, as reported by ProPublica, “had also been working with states across the country to help the Republican Party create a favorable election map.”

The invitation was sent to DeSantis’ deputy chief of staff, Alex Kelly, and two other aides, as well as Jason Torchinsky, a Republican election attorney and redistricting strategist, and strategist Thomas Bryan.

Torchinsky, a partner at a conservative law firm, has according to ProPublica represented the Republican National Committee, the Florida GOP, and several right-wing groups, such as the Koch-funded Americans for Prosperity. Invoices ProPublica obtained from the Florida Department of State show that Torchinsky spent more than 100 hours working for the DeSantis administration on redistricting, with his role appearing “to have been intimate and extensive.”

This guy is a national Republican election lawyer. If he was doing something they didn’t want, he would immediately lose all his GOP election and voting legal work.

The national GOPe are in on this.

It’s not just DeSantis.

SECTION 3 of the 14th Amendment DOES NOT APPLY TO THE PRESIDENT.

The President is NOT one of the positions explicitly mentioned in the text (Senators, Representatives, Electors). Was this some sort of oversight on the part of the authors of the 14th ??? You would think that mentioning the President would be front and center in this section if it was applicable. And why be concerned about “ELECTORS OF THE PRESIDENT” ???? If an insurrectionist running for President could be disqualified, his Electors would be fairly irrelevant at that point but yet they are one of only three positions specifically mentioned.

What about the next part that addresses “any office under the United States” ? Well that won’t work either since the President is not considered an office UNDER the United States, it is the Chief Executive OF the United States. In 1878 David McKnight authored his study of the Electoral System of the United States and in that work he came to the conclusion that the President is “obviously not” an office under the United States. Being that he wrote this just 12 years after the 14th Amendment was passed, and his view has not been challenged for over 100 years, it is pretty reasonable to assume his view represents the basic civic thinking of the time much more so than partisan thinking interprets Section 3 today.
