False. Excommunications which are incurred latae sententiae are incurred "automatically" by the act itself, without any act by a church authority.
Ferendae sententiae excommunication would require a decree by the bishop (for offenses where he has the authority under canon law) or by the Pope.
The lifting of an excommunication requires a judicial act by the bishop, or a priest to whom he has delegated the authority, or, in certain egregious cases, by the Pope. then you are in no position to decree Ted Kennedy RCs as excommunicated.
Sorry, last few words were from your post, which failed to edit out.
Sophistry, as an argument supporting the premise that self ID RCs who affirm favoring pro-lgbtq unions (even if only civil) even by voting Democrat, can be dismissed as not being members. Esp. as presuming this is the judgement of Rome. For as a canon lawyer explains, there are factors involved/ (including "imperfect use of reason").
Catholic answers even states: Canon 18 reiterates that in the interpretation of individual canons, “Laws which prescribe a penalty . . . are to be interpreted restrictively.” Excommunication is the Church’s highest penalty; therefore, it should only be applied with extreme caution. Canon 18 requires that excommunication be restricted to those cases only where a strict reading of the law warrants it....Excommunication is a word that is often bandied about by Catholics, non-Catholics, and the media. However, when properly understood within the context of canon law, it is a penalty that the Church only applies in the rarest of cases, as a last resort, and for the purpose of helping to bring about the offender’s repentance." And thus a competent Church superior is needed for you to know for use if a liberal RC is excommend, let alone all RC Democrats. And as Scripture as teaches, your actions show what you believe, and thus interpretation is manifest by actions, and since as said Rome manifestly treats even proabortion, prohomosexual public figures as members in life and in death then it reveals the Vatican's understanding of canon law. Thus laymen are in no position to decree Ted Kennedy RCs as excommunicated.
However, if you wish to declare RCs as excommunicated due to a qualifying letter-of-canon-law violation, then maybe you will tell all the FR RC's here who promote animosities or hatred against the living Apostolic See, which will result in arguments illustrating the need for an interpreter/judge if your judgment is going to have much effect.
Can. 1373 A person who publicly incites among subjects animosities or hatred against the Apostolic See or an ordinary because of some act of power or ecclesiastical ministry or provokes subjects to disobey them is to be punished by an interdict or other just penalties. https://canonlawmadeeasy.com/2017/04/20/can-you-be-both-a-catholic-and-a-sedevacantist/then you are in no position to decree Ted Kennedy RCs as excommunicated.
I do not think you meant to copy that into your reply, but it is a true conclusion.
