SCOTUS likely will hear oral arguments in March or April—the same time Trump is on trial for same charge. (If March 4 trial date sticks which seems impossible now)

But let’s say it sticks. And Trump is convicted by DC jury.

Then SCOTUS comes down with decision in June that reverses how DOJ (and Smith) interpreted 1512c2.

The same month Judge Chutkan would be prepared to sentence Trump.

I have a feeling this is going to work out in favor for Trump. This will end in disaster for Jack Smith and Judge Chutkan.

I read that the reason Jack Smith is skipping appeals court is he isn’t able to continue with the trial until this issue is resolved. So he’s hoping SCOTUS can make a quick ruling.

Yeah, I don’t see how this isn’t a gross misjustice to charge people as terrorists for just protesting and then being lured into the Capitol. It’s pretty clear all the confusion started when police started firing tear gas into the crowd and then retreating as they themselves were scattered by the tear gas.

There are essentially two questions before the Court.
1) when the President’s actions are within the ambit of his office, he is absolutely immune from prosecution, (As a subset: were Trump’s actions following the election within the ambit of his office)

2) Trump was impeached by the House for incitement of insurrection but acquitted by the Senate. The special counsel cannot second guess the Senate. (Sort of like double jeopardy)

Today Judge Chutkan stopped all work on the case until the SC decision is made. Looks like no trial in March.
