The FBI was refusing it because to accept it would be validating that it was accurate. So they pretended it wasn’t even hers. Then finally they excepted it.

That should be Project Veritas' defense.

If the FBI refused to accept it, then a reasonable person would conclude that it was not illegal to possess it, nor was there any investigative value to it.

Therefore, Project Veritas was free to use it as it saw fit. Otherwise, it would be entrapment by the FBI for refusing to accept it in the first place.
