Why do you think it cost him anything? He was never arrested or charged, and you can’t fight anything at the grand jury - you are not represented in the grand jury at all. If you are called to testify, you can refuse based on the 5th amendment, but if you choose to testify, you can’t bring a lawyer in with you. Perhaps he retained a lawyer to be prepared (I would in that situation), but there wouldn’t have been a whole lot for the lawyer to do until the grand jury process was over.
In Texas, cases like this always go to the grand jury. You cannot prosecute any felony in Texas unless the charges have been given a “true bill” by a grand jury.
It may be one of those weird jurisdictions where if somebody shoots somebody to death, the known facts must be laid in front of a Grand Jury for determination whether there is just cause to prosecute.
