Hiring a different attorney to handle an appeal is not replacing the trial court attorney. It’s just very normal practice.

Perhaps the best known example of this is Alan Dershowitz. He doesn’t often represent cases at trails. He specializes in appeals.

This is very, very common. Anyone making it out to be more than that doesn’t understand how stuff happens.

Often, the trial lawyer is burned out on the case…and just wants to get back to their daily grind. Not saying this is the situation…but it is common.

These media outlets just can’t help themselves. They know or should know why, instead they allude to something nefarious. Just like the Trump Christmas Eve family photo, “Melania Trump was mysteriously missing in the photo, leading many to speculate”. Well, she was with her dying mother and I would bet they knew that.

Apparently Habba withdrew her objection to the judge in the case co-officiating the wedding of one of the plaintiff's lawyers.

"The purpose of the letter was simply to inquire as to whether there is any merit to a recently published New York Post story which reported on the alleged existence of such a relationship," she wrote. "Since Ms. Kaplan has now denied that there was ever a mentor-mentee relationship between herself and Your Honor, this issue has seemingly been resolved."

Correct. Appeals is a specialty practice.

I guess it should also be stated, New York passed this law extending the statutes of limitations for civil suits expressly so EJC could sue Trump in this case - and it got a lot of other lawsuits against other men started too. They even put the cutoff for filing suits and sunseet of the law to coincide with the election year. But at heart, it’s part of the entire lawfare being waged against Trump coordinated by Democrats in various states.

one of my old buddies...after doing everyday cases for a while....that’s all he did was appeals....and and he became an Appeals Court Judge.

I am not an attorney.

However I understand that there are specialists in the legal profession just as there are in many other highly technical professions.

I would bet that Habba gave Trump a list of lawyers qualified to represent him on appeal.

Thank you for speaking sense. For one, you need your trial counsel focused on the ongoing trials and not the appeals. Two, the trial counsel makes the record, the appeals counsel learns to live with it and make it into art. It is a different world.

That happens a lot, because you go with the lawyers that have had more experience and success with appeals. Claus von Bülow hired Alan Dershowitz to appeal the 30 year prison sentence for the attempted murder convictions of his wife. He had been tried on two charges. von Bülow was granted a second trial where he was found not guilty of all charges, and walked out of court a free man.
