Disney’s lawsuit accusing Ron DeSantis of retaliation after ‘Don’t say gay’ flap tossed

A federal judge on Wednesday dismissed Walt Disney’s lawsuit against Florida Gov. Ron DeSantis and members of a state board for allegedly retaliating after the company criticized state limits on classroom discussion of sexuality.

DeSantis and other defendants had urged U.S. District Judge Allen Winsor in Tallahassee, Florida, to dismiss the case because Disney could not sue them over constitutionally enacted state laws. Winsor was nominated by then-President Donald Trump in 2019 to fill a vacancy.

“Disney lacks standing to sue the Governor or the Secretary,” the judge said in his ruling, according to a court filing. The company’s claims against the Central Florida Tourism Oversight district board also fail because “when a statute is facially constitutional, a plaintiff cannot bring a free-speech challenge by claiming that the lawmakers who passed it acted with a constitutionally impermissible purpose.”

A Disney spokesperson said: “This is an important case with serious implications for the rule of law, and it will not end here.

The dispute began after Disney last year criticized the classroom discussion ban, dubbed the “Don’t say gay” law by opponents.

*** State lawmakers stripped Disney of its control over the special development district that since 1967 had given the company virtual autonomy around its theme parks, including the Walt Disney World Resort.

The newly formed, DeSantis-appointed district, known as the Central Florida Tourism Oversight Board, then voided contracts that Disney pushed through just before the prior board was replaced.

Disney responded by suing the governor and board members for allegedly punishing the company for its political comments. ***

Some think that RINO means anyone that they see as a threat to their (false) deity. I think the acronym RINO has been co-opted- sort of like the way the homosexuals co-opted “gay.”

The whole idea of what is conservative has become bastardized. To some, “conservative” means whatever the Infallible One does or says. We live in very strange times.

Wow. Some sanity on this thread from several posters on this thread. What a refreshing change from that usually on offer.

Trump having won the nomination, I will vote for him in the primary. In the general I will vote for him and urge as many as possible to do the same. I want him to win with every fiber of my being. That said, he is a deeply flawed man. Frequently undisciplined and unfocused. To take but one recent example, the FBI interfered in the 2016 election, then tried to overthrow the duly elected President of the United States. Those who participated in these treasonous acts went unpunished. They have turned fascist and are a clear and present danger to the liberty of the people. Preferably the FBI should be abolished, but at the very least everyone the President can fire should be fired, and a thorough reform undertaken. Yet a few weeks ago Trump posted about his desire to build them a beautiful new HQ in central Washington. If that’s not fairly characterized as “unfocused,” I don’t know what would be

It isn't mentioned much but two things the current Florida legislature did in trimming Disney's wings was to eliminate the company's authority to build a nuclear power plant and to build an airport on their property without any state oversight what-so-ever.

Nearly six decades ago the Florida legislature gave Disney those privileges in the sweetheart Reedy Creek legislation.

About time. Can you image Disney World's perverted and unstable employees having in their private hands enough nuclear material for a hundred dirty bombs.
