Supreme Court Responds to Trump Request to Pause Immunity Ruling in Jack Smith January 6 Case

The US Supreme Court on Tuesday responded to President Trump’s emergency application requesting the high court pause the immunity ruling in Jack Smith’s January 6 case in DC.

Chief Justice Roberts on Tuesday responded to Trump’s emergency request and told Special Counsel Jack Smith he has a week to respond.

The Supreme Court gave Jack Smith until Tuesday, February 20 to file a response to Trump’s request to pause the appellate court’s ruling on immunity.

Last week a federal appeals court stacked with Biden judges denied Trump immunity in Special Counsel Jack Smith’s January 6 DC case.

The three-judge panel for the DC Circuit Court of Appeals ruled on Trump immunity claims: Florence Pan (Biden appointee), Michelle Childs (Biden appointee), and Karen Henderson (George W. Bush appointee).

“We have balanced former President Trump’s asserted interests in executive immunity against the vital public interests that favor allowing this prosecution to proceed,” the three-judge panel wrote.

“We conclude that ‘concerns of public policy, especially as illuminated by our history and the structure of our government’ compel the rejection of his claim of immunity in this case,” they wrote.

John Roberts should not have even done that, but he hates Trump. So, I guess we should all expect the worse out of him, because he has shown that the worst is usually what we get from him.

Nobody should be immune - not even Supreme Court justices, but they should be given significant benefit of the doubt if they acted in good faith.

No!

If Biden caused an alien criminal to be given the opportunity to vote for partisan gain (and kill in the USA), Biden should face the justice system.

Your answer is dangerous, for if that were the way it operated, then every president would come under fire for things they do, even as the sitting president. Talk about creating utter chaos. Nothing could be worse for this nation.

Apples & Oranges argument presented. What Trump did was nothing more than losing candidates do when they lose the general election, question its legitimacy. Trump did nothing to endanger this nation.

A year later in Bernard v. County of Suffolk, the 2nd Circuit said prosecutors could not be sued for putting government officials on trial to satisfy a political vendetta. “Racially invidious or partisan prosecutions, pursued without probable cause, are reprehensible,” the court said, “but such motives do not necessarily remove conduct from the protection of absolute immunity.”

It’s rich that prosecutors and judges claim immunity for themselves even if they should commit crimes:

The Supreme Court announced the doctrine of absolute immunity for prosecutors in the 1976 case Imbler v. Pachtman. The Court ruled that a man who had spent years in prison could not sue a prosecutor who allegedly withheld evidence that ultimately exonerated him. The justices approvingly quoted a sentiment that Learned Hand expressed as a judge on the U.S. Court of Appeals for the 2nd Circuit in 1949: “It has been thought better to leave unredressed the wrongs done by dishonest officers than to subject those who try to do their duty to the constant dread of retaliation.”
