Texas law allowing police to arrest migrants suspected of being in country illegally blocked by federal judge

A federal judge in Austin on Thursday halted a new state law that would allow Texas police to arrest people suspected of crossing the Texas-Mexico border illegally.

The law, Senate Bill 4, was scheduled to take effect Tuesday. U.S. District Judge David Ezra issued a preliminary injunction that will keep it from being enforced while a court battle continues playing out. Texas is being sued by the federal government and several immigration advocacy organizations.

Ezra said in his order Thursday that the federal government “will suffer grave irreparable harm” if the law took effect because it could inspire other states to pass their own immigration laws, creating an inconsistent patchwork of rules about immigration, which has historically been upheld as being solely within the jurisdiction of the federal government.

“SB 4 threatens the fundamental notion that the United States must regulate immigration with one voice,” Ezra wrote.

Gov. Greg Abbott signed SB 4 in December, marking Texas’ latest attempt to try to deter people from crossing the Rio Grande after several years of historic numbers of migrants arriving at the Texas-Mexico border.

The law seeks to make illegally crossing the border a Class B misdemeanor, carrying a punishment of up to six months in jail. Repeat offenders could face a second-degree felony with a punishment of two to 20 years in prison.

The law also seeks to require state judges to order migrants returned to Mexico if they are convicted; local law enforcement would be responsible for transporting migrants to the border. A judge could drop the charges if a migrant agrees to return to Mexico voluntarily.

I used to respect Courts and their judges' opinions. But, that was when they respected the Constitution and didn't rule according to their political biases.

At this point, I say "screw it". Texas LEOs should just keep arresting the illegal aliens when they catch them. "Illegal" being the key word here.

A Court whose ruling is illegal (see US Const., Art. IV, Sec. 4) should be ignored. The States have every right to stop this invasion (illegal immigration =invasion) and should take the feds to court for their unconstitutional and thus, illegal behavior.

The Supreme Court told the White House Pedo that he could not use tax dollars stolen from American families to pay for the college diplomas of his deadbeat voter base. U.S. District Judge David Ezra - bit of History.

Judge Ezra was appointed to the United States District Court for the District of Hawaii in 1988, becoming the youngest federal judge in Hawaii history, and was the longest-serving active federal judge in Hawaii’s history.

What’s fundamental about it?

The States negotiated it in the Constitutional convention because they didn’t want one state letting in miscreants who could then cross into their states without pass or passport. They wanted uniformity in the rules of naturalization so that letting anyone wander in from another state would be a reasonable risk. There is nothing in this agreement that includes people in the country illegally from being treated as if they had gone through such a naturalization process; on the contrary, they are exactly the people that the agreement was meant to bar.

But David Ezra don’t git that.

This is SO infuriating. The GD federal government refuses to enforce the laws so the states have to step in. Then the same GD federal government sues the states for trying to do what the GD federal government should have been doing.
