Grandmother wins $3.76M suit after bungled SWAT raid destroyed home to find iPhone

Shocking body camera footage showed at least eight officers dressed in tactical gear and carrying automatic rifles jumping out of an armored vehicle and approaching Johnson, who was just wearing a black bathrobe and a bonnet, the following day.

They then proceeded to use a battering ram to get into Johnson’s garage even though she explained to them how to open the door, and broke ceiling tiles to get into her attic — standing on top of one of her brand-new dining room chairs, according to a lawsuit Johnson filed in December 2022.

These cases of stupidity and criminality from Public Servants are far too common and there needs to be real consequences for these actions.

1. In all case where a Public Employee is found Liable for violating the civil rights of another, said person shall be Prohibited from using, owning or possessing any firearm or ammunition.

2. Any and all claims of "Qualified Immunity" involving the violation of anyone's Civil Rights Shall be considered a Guilty Plea to a Felony if Taxpayers are required to PAY any Judgement or settlement.

End qualified immunity, require a bond for each police officer, just like a plumber, or electrician, or any other professional and when the bond becomes too expensive, that bad cop goes away. Game over.

People should be able to sue for this stuff, and the financial awards should come from the budget of the dept who did it.

My wife’s phone says it’s located at least a half mile from our house...................

Good. The cops and departments need to be accountable. Settlements should not just paid by the taxpayers. Too much of that and “we investigated ourselves and didn’t nothing wrong.”

For a long time, my computer had me living in Marysville, WA, which is about 30 miles and six cities NE of where I live and is a place where I've never lived.

Maybe put automatic rifles in the faces of their family. Give them a taste good and hard.

I keep telling my wife that it’s all dependent upon what cell towers the signal from the phone is pinging on and that the radius of three towers intersecting at that signal strength determines the location, but she thinks someone is ‘hacking’ her phone..............

Up through the “civil war”, officers in the state militias were elected. Federal officers of course were commissioned by Congress.

It would be completely reasonable to require all police officers to stand for election on a routine basis, and be required to live in the precinct that they patrol. That actually used to be the norm in many cities.

A bond is not a bad idea, but the real question is: who are these Special People? Do they have any relationship to the people they “police”, or are they just meat robots? Who puts them in their positions - the populace or some hiring panel with an agenda?

As a corollary to this - States used to have "reverse condemnation" laws under eminent domain - whereby government would be responsible for costs of property "taken," without due process, as a consequence of government policy, or government inaction

The George Floyd riots were a perfect example - Government would be held responsible for losses for NOT having police stop rioters, or for government officials encouraging rioters in the first place.

These laws started to disappear in the first part of the 20th century (under progressives, of course) and disappeared entirely just in time for the race-riots of the late 1960s

Actually, you just need to get them out of uniform and you will find rather quickly they are pussies and afraid of their own shadow. A friend of mine was out to dinner with his wife one night with some other friends and there was a table full of loud obnoxious drunks, He politely asked them to tone down the language a few times. Finally the Big Guy at the table got pissed off and challenged him to go outside, well my friend just happened to be Boxing Champ and beat the holy Crap Out of him. He and his thug friends were Off Duty LAPD and the Restaurant Owner comped my friends meal because everyone hated the loudmouth thugs that the Police refused to do anything about when they came in and were called.

Three deputies went to one of my rentals for a domestic disturbance. They spotted if I recall, thirty 12-inch-tall pot plants, which they evaluated at fifty thousand dollars. The couple was drunk, so the deputies put them to bed. That night they came back and bashed the door in. The SWAT team brought their armored car, and they wore their cosplay armored suits. It was purely an opportunity to practice, to get the extra pay and to play big city cop. They did somewhere in the neighborhood of a thousand dollars in damage. They are not responsible for fixing anything they damage. Frankly, I’m lucky they didn’t drive the armored car into the house. (Fifty thousand dollars. I suppose any excuse is excuse enough and the number looked politically good, but if that was the desire they shouldn’t have told the paper the number and size of the plants.)

Not only did they knock the door down but left it there with the house wide open to anyone who wanted to go through and rob it. The neighbor came over and laid the door back in the frame, so it looked closed. But the whole don’t give a damn about anyone less’s property was clearly on display.
