Good question. The appellate court upheld the circuit court's decision. By the way, the Fifth Circuit Court of Appeals is a conservative court -- as is most fifth court district courts.

The Supreme Court does not necessarily have to rule totally in favor of our side by simply vacating the stay. There are a host of other decisions they could make -- some more favorable to us than others.

I have followed this case for a while. Another commenter posted that this could be as big a Roe v Wade or Brown v Board of Education. I agree 100%!
