I agree with you. how do you view this ruling? Maybe there is something in the fine print or over looked we're missing?

how do you view this ruling? Maybe there is something in the fine print or over looked we're missing?

This ruling furthers the SCOTUS ruling against Arizona's SB 1070 that Gov. Jan Brewer signed in 2010 and the Obama administration promptly sued over.

The SCOTUS justification was that the state laws interfered with the federal power to prioritize resources.

The court basically said that federal prosecutors had "prosecutorial discretion" over where to spend their efforts (e.g., which illegals to prosecute and/or deport), and any state law infringes on the federal agencies' authority to exercise discretion.

In other words, the court said that if a state like Arizona or Texas kept arresting illegal aliens on their own and then turned them over to Border Patrol or Homeland/Immigration, that forces those agencies to have to deal with the illegals which takes time and budget away from other priorities that they had the power to set.

Letting states arrest illegals forces priorities onto the federal government, which the courts overturned.

It's like the states are the serfs for the federal government and not the other way around, which is what the 9th and 10th amendments were supposed to be for.

That's why I argue that we've lost our way with understanding the limits of Article I Section 8 Clause 4. Establishing uniform rules for naturalization should be limited only to admitting the people, not protecting the border.

Let the states police their own borders and take that budget away from the federal government. Make the federal government focus on managing the entry checkpoints and the naturalization processes.

I would make the further argument that our "border control" violates the 14th amendment equal protection clause. What about interior states? Are they entitled to the same federal border protection as states that share borders with Mexico or Canada?

If the states are sovereign entities, then their borders are their own territory to protect equally, whether interior or facing a foreign country. Do away with federal border control and let the states maintain and police their own borders against illegal trespass.

I wish people would quit calling them migrants. The term migrant lends credibility to their illegal actions!

Call them what they are, ILLEGAL ALIENS.

Us silly little people are not allowed to enforce our own laws. Only omnipotent fedgov is allowed, and will enforce them in a DEI way (Destroy Excellence and Initiative).

If it is ‘somebody close to the border that speaks with an accent’

Or claims to not understand English at all. Please go away. We cannot survive fools.

It is twisted that when it came to President Trump trying to secure the border, SCOTUS thwarted him in every way.

You can't say that loud enough. I've been noticing this for over a decade. And remember, Obama violated our border policy with a unilateral "dreamer" scheme, and then violated a court's order that it was unconstitutional, without any consequences.

You obviously don’t respect or understand the Constitution then - exceptions should be made for accents according to you. Did I say “doesn’t understand English at all”?. No. Putting words into somebody’s mouth and then calling them “an idiot” for it is very low IQ, like a leftist. It’s also against FR policy.

I thought more of you. Opinion adjusted. Maybe you should look at my history here a little more. If you can’t have a discussion without insulting a fellow (long time) FReeper...well, that says more about you than I.

Good point. But, as others have said, NOTHING is going to be done about States Rights as long as States continue to take Federal Dollars. And many states would close up shop without those Federal Dollars. You can also see WHY Fedzilla picks on certain states to take advantage of while conducting their nefarious plots against ALL of us. They’ve got them by the short hairs, for sure!

This ignores the fact that absent fed mandated spending the states come out ahead without federal money.

However it is also certain that 95% of state leaders are ignorant of this.
