No one said “harass” illegal aliens. They should be arrested upon reasonable suspicion that they are here illegally. Watching them wade across the Rio Grande is sufficient to “stop and frisk” and inquire.

What I do respect about SCOTUS rulings are they must be careful to not open doors that might infringe on our rights, for all of us. Just having a ‘suspicion’ isn’t enough - which is what I said. Of course, seeing somebody wade across the Rio Grande is beyond ‘suspicion’, the crime is witnessed by law enforcement. This isn’t what is being put into question though.
It all comes down to what is written exactly. If it is ‘somebody close to the border that speaks with an accent’, does that on its own rise to the level of ‘reasonable articulable suspicion’? I’d argue it doesn’t, which is what I’d think is the caution of the SCOTUS.
That said, we’re under an invasion - the military should be at the border. Giving police broad powers after the fact is dangerous but more severe government action should be stopping it in the first place.
