Man's farting conviction overturned

An Australian man who broke wind in the foyer of a Melbourne police station has had his conviction for offensive behaviour overturned.

David Grixti had been fined $200, the equivalent of £71, by a court in June.

He broke wind in the station after being arrested for drinking offences.

The decision was appealed to the Victorian County Court, which has found him not guilty. The prosecution couldn't establish flatulence was a voluntary act.

A local legal services manager criticised police for taking action against Mr Grixti, saying it was absurd a natural bodily function was criminalised.

Police have refused to comment, reports the news.com website.

I believe that the police officer who arrested Mr. Grixti pulled the latter's finger immediately prior to the incident, so he's the one who should have been charged, at least as an accessory.

This happens in China all the time because they use those little Chinese finger cuffs. It's a country rich in gas.

I think I am more concerned that the poor man was arrested for flatulence in the first place.

My mother always told us " Better out and have a frolic than in and have the colic."

A couple years ago my nephew and his wife had their first baby. This baby cried all the time. When he was about 3 months old I asked how was the baby. My nephew replied. " He is just fine now and quite pleasant since he learned how to fart."

Not around sparks or other open flames, I hope. Glass jars can become dangerous shrapnel.

I know, I know this is not what one call breaking news, but in a way it is a breaking story for the FFA (fee flatulence assn)

I think the guy's defense should have been that he simply could not holt it. He would create a new catagory for the Americans with Disability Act No guilt, no shame and if anyone criticizes you, we shall consider it a hate crime. And the real criminals would be the fart-o-phobes.

Surprising that he got off on the charge - other reports stated he had a hostile air about him. They tried to keep this story quiet, but it leaked out anyway. The truth was obvious as it spread and public sentiment turned against him. Throughout the trial there was a dark cloud over the case. In the end it seems to me that this guy squeaked by with his aquital. The far reaching implications of this decision could cause quite a rumble.
