Te US Supreme court has ruled that militay courts are both fair and constitutional. As long as these military courts fall under the ultimate review of the US Supreme Court I am ok with it.

One more thing if Military courts are used then the Geneva convention governs the prisoners and they are no longer terrorists but Prisoners or War. They are not allowed to be questioned, detained, seperated from fellow POWs and are allowed unsupervised visitation rights by the Red Cross and others.

Funny you should bring up John Dean. I followed with some amusement the fairly recent law suit he was involved with. G.Gorden Liddy, a rather odd duck, accused John Dean of setting up the whole Watergate burglery fiasco bringing down Nixon. Dean did not win this law suit.

Economics is a factor here too. The milllions spent per legal case in U.S. Courts when compared to salaried tribunal judges and some guards wages, obviously frees up a lot of money saved from going into an increased tax burden on U. S. taxpayers.
A tribunal system should be used more often to help reduce the backlog of our regular court cases.
Arizona has lots of room for more tent-city jails.

Did you catch the Newsweek report that President Bush has insisted that he and only he will decide who is tried in these military tribunals? If you interpret Bush as a "good guy," this would be a good check on the power of these things, though even that generous interpretation of his motives would have to acknowledge his interest in keeping secret CIA/Saudi/Usama/etc ops dating back to 1981 . . .

Actually, I believe Liddy's thesis (and that of the book Silent Coup) was that alhough the Watergqate coverup may have been engineered to take down Nixon, the burlary itself was intended to take DNC files naming Dean's wife as a member of a DNC-run callgirl/blackmail ring.

your speculation.
Chill.
IMO these courts are going to be used against the foreign enemies of this nation who also happen to be flush with cash (petro$$) which c&w/ould simply be used to buy justice.
These "terrorists" decided they wanted to, play army & I say fine.
Be subjected then to adjudication by army men & if found guilty?
Pay the soldier's penalty; hang by the neck 'till dead, *or*, be put against a wall & shot.

Thanks for this post. I had been under the impression that these tribunals would be strictly limited to non-US citizens, for whom there is no expectation of protection under our constitution. I could never accede to trial of US citizens in such tribunals, and I am sure that this is an idea which is entirely unconstitutional.
