3. Myth: H-1B visa holders take technology jobs from American workers, relegating U.S. citizens to lower-paying, non-technical jobs. Reality: Employers may hire workers under H-1B visas only if they cannot find suitable U.S. citizens. The Department of Labor's Employment & Training Administration (ETA) set up a technical-skills training grant program, awarding cash to business partnerships that provide computer and engineering training to American workers. The ETA says its goal is to "lessen their dependence on high-skilled foreign workers," not increase it.
This sounds like propaganda written by the INS in conjunction with big business. I personally know 2 highly qualilfied computer engineers who have been laid of since last summer.

You forgot to add the part were INS does not know this person gets laid off, and he is now free to do what he wants, just like the other 10 million plus illegals in the country.
INS Policy = Once your in, your in.
INS has no internal enforcement. INS leadership, or lack thereof, does not desire to enforce the growing problem of visa overstays.

Companies who engage in this practice will get what they paid for, literally. Ask any American engineer who works with these guys. I'd advise the out-of-work engineers to move on to someone who appreciates their talents. And meanwhile, file for unemployment to stick it to the company pulling such shenanigans.
