Like it or not, the Justice dept. has to defend the law. They could appoint an outside lawyer to handle the case.

That statement is false. The Solicitor General and the Attorney General are both subject to the President's direction. Both can be instructed to oppose a law, rather than defend it. This has bee done at least five times, by various Presidents.
