House Appropriations Committee Defeats Section 245(i)
and Ban on State/Local Police Cooperation with INS

REP. SERRANO (D-NY) AMENDMENT TO MAKE SECTION 245(i) PERMANENT

In a stunning defeat for supporters of open borders and non-enforcement of laws against illegal immigration, the House Appropriations Committee last night defeated an effort to make Section 245(i) permanent. The effort was made as the full Appropriations Committee was marking up the fiscal year 2002 Supplemental Appropriation. As expected Rep. Jose Serrano (D-NY) offered his amendment to make this amnesty permanent. However, on a voice vote the committee approved a substitute for the Serrano amendment mirroring the temporary Section 245(i) extension approved by just one vote in the House last March. The substitute, offered by Rep. Sam Farr (D-CA), was then defeated when two Democrats joined with all but four Republicans on a vote of 27-32. As soon as the recorded votes officially reported by the committee, FAIR will post the tally on our website.

Over the last few days FAIR, its activists and members campaigned nearly nonstop to defeat the Serrano amendment and the effort has paid off. Without those efforts, supporters of Section 245(i) might have succeeded in passing an amnesty without the benefit of full debate and in spite of overwhelming popular opposition. Your tireless efforts are much appreciated and, more importantly, have spoken truth to power by making clear that no form of amnesty is acceptable to the vast majority of the American public.

REP. SERRANO (D-NY) AMENDMENT TO BAR STATE AND LOCAL POLICE COOPERATION WITH THE INS EXCEPT IN CRIMINAL INVESTIGATIONS

Prior to defeating the amendment on Section 245(i), members of the Appropriations Committee also defeated an amendment clearly intended to gut enforcement of laws against illegal immigration. The amendment, defeated on a vote of 23-33, was prompted by pending plans at the Department of Justice to use the resources of state and local police to assist in apprehension of suspected terrorists, foreign nationals with deportation orders against them and other illegal aliens. Taken together with his amendment to make Section 245(i) permanent, "these two stealth amendments leave little doubt about what Serrano,s real agenda is, said FAIR Executive Director Dan Stein. "They are about making sure that immigration laws are not enforced and that people who come here illegally will eventually be rewarded for breaking the law.

I wouldn't be surprised if they tried to attach it to every bill that comes up for a vote.

I don't blame him. It would be hard to arrest two-thirds of the people in Houston. And they wouldn't have anywhere to put them.

But the temporary extension, which is almost as egregious, remains in the House committee version. People are going to have to raise hell before this comes to the floor if they want to stop this nonsense. Next: a bill to grant amnesty to bank robbers if they pay a $1,000 fine.

These sun-uh-biches would bite their own arm off and sell it to get a vote.

Better question - what percentage of the Houston Police Dept. and any local sheriff's department managing local jails are aliens themselves?
