SCA12 (Perata) - This bill would create a "Sales and use tax" of 5 cents per cartridge or component sold in California. This bill has passed the first of three required State Senate committees, the Senate Health and Human Services Committee on Wednesday, June 5, 2002. If it passes all three committees, and passes on the Senate floor, it would then go to the State Assembly and begin the process there. If it gets out of the Assembly, it would have to be signed by the governor and then it would be on the ballot. SB682 & AB496 These bills seek to repeal part of the Civil Code 1714 that deals with product liability. These bills were redrafted and gutted/amended from bills that were initially introduced to do other things. These bills were changed after the anti-gun advocates lost their "101 California Street lawsuit" against the firearms industry in the California State Supreme Court.
The repeal of current law would only open the door of litigation to the manufacturers of lawful and legal consumer products. Manufacturers of lawful products should not be held responsible for the actions of criminals or any person who uses the product in a negligent manner.
It is important that everyone continue to contact the legislature. These bills could be voted on at any time in the Assembly (SB682) and in the Senate (AB496).
SB682 is in the State Assembly. AB496 is in the State Senate.
ACTION REQUESTED: Please contact the following Assembly Members and ask them to OPPOSE SB682.
