I would say that most politically active Americans would want the Bush administration to take a stand here and file an amicus brief.

Most likely, due to the current paintng of the republican party as South Africa redux, the Bush administration will take a pass.

SCOTUS does. SCOTUS always pays a lot of attention to government amicus briefs.
