Fired Conservative Columnist Sues Campus Newspaper

Davis — Fired conservative columnist Igor Birman filed a small claims case today with the Yolo County Superior Court against his former employer, The California Aggie and its editor-in-chief, Fitzgerald Vo, alleging breach of contract and wrongful termination.

Birman was dismissed from his position as the sole conservative columnist at the Aggie on January 1, 2003, by Fitzgerald Vo, despite a contract lasting until the end of June 2003. In his termination notice, Vo cited Birman’s “tendency to enrage members of the opposing causes” as the reason for the dismissal.

Birman's column, The Right Stuff, provided the campus community with conservative commentary, expressing strong support for the war on terrorism and invoking a lively debate on issues ranging from the Israeli-Palestinian crisis to reparations for slavery.

“When my family and I fled the former Soviet Union a decade ago, we left behind a nation where laws were systematically ignored and persecution ruled. In silencing the sole voice of dissent at the Aggie, Mr. Vo has committed the same kind of assault against the freedom of thought that my family would have faced in the USSR for speaking out against communism,” Birman said, recounting his experience as an immigrant. “Mr. Vo has fired me illegally, and in this society, whose very essence is based on the rule of law, such grotesque disregard for the law should not stand,” he added.

Birman is seeking damages in the amount that he would have received had his contract been allowed to run its course, in addition to court costs and miscellaneous legal fees. He said, however, that his intentions do not include personal monetary gain. “If I am fortunate enough to win this case, I will donate whatever amount I receive to the Young Conservatives Foundation, in order to strengthen the conservative movement both at UC Davis and across California, so that conservative thought is given an opportunity to grow in this climate of general hostility,” he said.

The case is Birman vs. The California Aggie, et al., C.V.CL 0353. Birman may be reached at 530-754-3339. The termination notice and a copy of his contract will be provided upon request.

This is the latest from UC Davis. I posted a press release two weeks ago about me getting fired from the UCD campus newspaper for enraging the left. I'm not giving up without a fight.

Meanwhile, the newspaper hired a "replacement" to do my column. One problem though - this guy is a liberal.

I hope you're having a good new year. Thanks for giving me the opportunity this year to edit your columns. Due to the increasingly tighter spaces in The Aggie and the relative impact of your column, I regret to inform you that I would have to cut your The Right Stuff Column.

This is due to several reasons, first of which is the dryness in your column's tone. I have told you several times that I would like to hear more of your voice in your columns, but that seems to be muddled in a lot of similarly versed right-wing rhetoric that I have heard before. Again, I would like a unique perspective, and you don't seem to provide it.

Secondly, the tone of your column seems to have a tendency to enrage members of the opposing causes. Judging from the range of feedback I have received, your column does not seem to spark dialogue, but anger that only increases a tit-for-tat response.

Please feel free to contact me if you have any more concerns or questions.

keep up the good work.

I have a friend in the college Republicans who was denied an(unpaid)job with the campus paper (that she was overly qualified for), but didn't get it because of her lengthy answer to this question on the application:

4. If you could change anything about "the specatator" what would it be?


She wrote some "right-wing rhetoric" about not presenting both sides of any issue; and for some reason they never called her back.


Bias? What bias? I don't see any bias.

As supportive as I am of you in this situation, I don't think that it's really a good idea to publicly post the guy's home phone number. Work numbers are one thing but home numbers are quite another.

Just a suggestion - you might consider sending a FReepmail to Admin Moderator to get it removed from your post.

Good luck, sir. Fight the good fight. Might I suggest that if you win some sort of monetary award, you use it to set up a competing "fair and balanced" paper on campus?

Did he ever think that may be the fault of those providing the feedback. If they refuse to think or engage in civil dialogue, what are you supposed to do?

Might we then expect left-wing writers who similarly enrage their opponents on campuses across this country be dismissed as well?

You seem to have a better grasp of what the United States is all about than many native citizens.

Now lord knows I never been called the brightest bulb on the tree but I thought thats one of the things columnists werte supposed to do.
