Security guard arrested over death of robber [More Gun News From the U.K.]

A supermarket security guard could be charged with causing the death of an armed robber who was shot in the head with his own gun during a struggle.

The 36-year-old Tesco guard, who is being treated in hospital for a bullet wound to the leg, has been arrested.

The shooting happened on Thursday morning when three men robbed a Securicor van outside a Tesco store in Leytonstone, east London. The security guard and other staff intervened, and during a scuffle a 45-year-old robber was shot in the back of the head. Witnesses said five or six shots were fired.

The robber, who wore a boiler suit and balaclava, died in hospital five hours later.

One witness said the security guard was lying wounded on the ground shouting, "Call an ambulance", while two passers-by tried to revive the robber.

The other two robbers made off in a getaway car with thousands of pounds from the security van. The car was later found abandoned. It is believed the two robbers escaped in a second vehicle.

Detectives questioned the guard, who is not thought to be seriously injured, in hospital yesterday. Neither the guard nor the robber has been identified.

A spokeswoman for Tesco said: "A Tesco security guard is helping the police with their inquiries and we will continue to co-operate fully with the police investigation."

A spokesman for the Metropolitan Police said a file would be sent to the Crown Prosecution Service after all the evidence had been gathered.

It will be for the CPS to decide whether the guard acted unlawfully and if it is in the public interest to prosecute. A spokeswoman said all the circumstances of the shooting would be considered before a decision was made. The process could take some weeks.

This decision will take weeks? I would like to know what there is to decide. Who would want to live in a government with a system like this?

I share your incredulity.

All systems, even the UK victim disarmament regime, invariably travel to an overcorrection before swinging back through equilibrium. If the British survive as a nation, it will be due to the awakening of the massive middle from their socialist slumber and a concomitant resurgence of common sense. It could be messy as the common folk reassert rights to self-defense. Unfortunately, they will be poorly armed at the outset. (Lesson: Never, never register or surrender your guns).

In England there is no right to self defense, if an armed robber comes into your house, you are just supposed to die.

This really doesnt have anything to do with guns, if the guard had killed the robber with a ball bat he still would be sent to prison. Simply in England you do not have the right to defend your life, that is the law there.

Sure it does. Nobody is supposed to have handguns in England, right? They were banned, weren't they? So what was this criminal doing with one?

Let's take your example one step further. Let's say the perp attacked the guard with a baseball bat. The guard, in fear for his life, snatches the bat and hits the perp over the head killing him.

Except for the nutty laws, I can't see how the guard could go to jail in either case. COMMON SENSE would dictate that he should not. Now, if the guard had his own ballbat and snuck up on the perp and popped him one, now your talking!

As much as I agree about the problems in England, you really need to read the story again and understand the difference between common usage in England vs. the US.

It is pretty clear that the "security van" was what we would call an "armored car". Even in the US armored cars have security guards, and no one remarks on how lawless we are because of it.

The real issue is that in the US the guards are armed, and if they shoot an armed robber that is very seldom a cause for a trial (although you never know in places like Chicago, NY, and Kali).
