Judge upholds protest limits at The Masters

AUGUSTA, Ga. -- A federal judge has upheld the law that allows Augusta's sheriff to regulate protests outside this week's Masters.

Monday's ruling was only a partial victory for city officials, however.

U.S. District Judge Dudley H. Bowen Jr. hasn't decided if Sheriff Ronald Strength violated his discretion by denying Martha Burk's group the right to protest at the front gates of Augusta National.

Burk is planning to protest Augusta National's all-male membership on Saturday. Aware of the time constraints of the case, Bowen said he would decide the second issue soon.

Burk, who heads the National Council of Women's Organizations, wants to post 24 demonstrators outside the front gate of Augusta National and 200 more across the street during the Masters' third round.

Strength, who has broad authority over public protests, has told Burk and other groups the only place they can protest legally is a 5.1-acre site nearly a half-mile from the gate.

Strength says there's too much traffic along Washington Road, which runs in front of the club, to ensure safe protests.

The judge, in issuing Monday's ruling, said: "The ordinance, on its face, demonstrates that providing for the safety of the protesters and onlookers was the primary concern of the (city-county) commission. It is axiomatic that a government has a compelling interest in providing for the safety of its citizens."

It's going to be extremely tough to say that the good Sheriff abused his discretion when others filed for protests and were told they could use the same site Burk was offered.

I wouldn't put it past them, but it would be really stupid to try, and would absolutely kill any future protest efforts by them, or anybody else. It would be a great thing for the Club long term.

We should hire a plane to buzz the crowd and drop leaflets with pictures of Rachel Corrie on them. Then have a bulldozer sitting about fifty feet away and sputtering.

I find it sad that we have slipped so far from our original course that it is even suggested that there is a federal issue here.

This isn't going anywhere. If an appeal is taken, it will be to the conservative 5th Circuit, right?

Don't be surprised if you'll see several women be escorted from the course after purchasing tickets to get inside and then disrobe or cause some other distraction.

These people are crazy and embittered enough to try just about anything.

It's my understanding that tickets are hard to come by - that demand far exceeds supply. Also, NO disruptive behavior is tolerated. Little will be seen or heard from the hags near or on the course.

Tickets (badges, actually) are VERY hard to come by. If you sell your ticket to someone who is escorted out, you lose your right to buy your badges. Forever. Anyone caught selling their badge to one of these hags would be excommunicated from Augusta, and should be dragged down Bobby Jones Expressway behind one of the Cadillac Ecalades that the players drive while they are in town. The gates are small and secure. I doubt they could "storm the gate", Certianly not without becoming intimately familiar with the inside of the Richmond County Jail. Don't look for Burk's bunch to be very visible near the main gate. In all honestly, it really wouldn't matter anyway, the gate is well off the street. I don't think you could see the protestors from the course or the clubhouse anyway, unless you really went out of your way looking for them.

Burk is going to get a rough welcome to Augusta. I haven't talked to anyone in this city, male or female, who supports her.

Since early last week, there has been a guy sitting in a tent at a major intersection about a quarter mile from the National's front gate, selling "We Support Hootie" buttons and other anti-Burk items.

I normally keep well clear of the National and its environs during Masters week due to the chaotic crowds and traffic, but this year I believe I'm going to brave the traffic just for the opportunity to ......ahem......."wave" at Burk and her "Rent-a-Demo" pals.
