After I filed my brief in opposition to the petitions for certiorari from the Office of Independent Counsel and Foster's widow and one of his sister's, the OIC and the two Foster family members filed replies to my opposition. They were filed in the last couple of weeks and are now in the Foster section of my web site. Unless something unusual happens, this should conclude the briefing on the petitions for certiorari, which are petitions asking the Supreme Court to hear the case on the merits. I expect the Supreme Court to decide in the next month or so whether to hear the case on the merits.
It should be noted that Accuracy in Media has a Vincent Foster FOIA case that was just orally argued before the United States Court of Appeals for the District of Columbia Circuit on April 11, 2003. That appeal follows a decision by the district court judge in that case denying the great bulk of AIM's FOIA request. One of the issues in the AIM case is that the D.C. Circuit requires a FOIA requester to show compelling evidence that the agency denying the FOIA request is engaged in illegal activity." The Ninth Circuit does not impose that tough standard on FOIA requesters. I argue in my case that the D.C. Circuit is wrong to impose that standard and the Ninth Circuit is correct in not imposing that standard. If the Supreme Court takes my case it might rule that the standard being used by the D.C. Circuit to restrict the ability of FOIA requesters to obtain documents is invalid. This could make the difference in AIM's case and would make the D.C. Circuit much friendlier to FOIA requesters, including any other FOIA cases pending in the D.C. Circuit's district courts regarding Foster.

The fact that she and Foster's miltiple-year affair has all but escaped the memory of the Clinton legacy.

This may be a naive point of view but I've got to express it. Congratulations on the determination of Mr. Favish to want the truth to come out. I salute him mightily. However, the Clintoons are so well protected by the forces that be, just like the perpetrators of the Kennedy assassination, the likelihood of ever finding out the real truth is next to nil. The Clintoons have a death trail behind them that's "a mile long" (to use an old adage). And the sticking point is that there's no solid evidence to connect them, just innuendos. The vast left-wing conspirators won't let the information out. If there ever were a trial, just like the 1976 congressional hearing on Kennedy, no one will be brought to justice. In the '76 hearing, the result after testimony and presentation of the facts, the wussy congressmen ruled that there was a "probable" second gunman. Unless Mr. Favish has the money and time to pursue it, isn't he just chasing his shadow?
