Isn't suing Iraq moot since the government that was responsible for the actions being litigated no longer exists?

Since this is meaningless and they'll never see a dime of it, why didn't this judge make a complete mockery of our court system and award them 104 GAZILLION DOLLARS!!!

I suppose that when they find Saddam the billion dollars he took from the bank there, they can pay off the plaintiffs in this lawsuit.

I'd be curious to see Harold Baer's track record as a judge. I seem to remember hearing his name before in a very bad light when it came to the judicial system in New York. He may have been the guy who ruled that fleeing from the police could not be considered "suspicious behavior" because people had a reasonable fear that they would be abused by the cops.

The loony left should be very satisfied that this has been proven. They support trial lawyers and the continued stretch to legislate through the courts. If the decision was made in this court, then it must be fact. Therefore the link has been proven and the war with Iraq was morally justified. Is M.Moron happy now?

mmmm....IIRC, the US has frozen Iraqi assests that might be used for the payoff.

The default judgment was granted by Baer after public announcements of the lawsuits failed to attract a response from any of the defendants.

This case was a joke from the start, since the court probably had no jurisdiction in the matter anyway.

You remember correctly. From courttv: Federal Judge Harold Baer has removed himself from the case that landed him at the center of a national controversy. The judge's decision to throw out $4 million worth of narcotics seized from a defendant's car was criticized by President Clinton and politicans from both parties. The judge later reversed himself, allowing the narcotics evdience to be used at trial. In this opinion and order, he denied a defense motion that he recuse himself, and then recused himself.

above from http://www.courttv.com/legaldocs/misc/baer.html

The quote pertains to U.S. v. Bayless

You're right: Other news reports are stressing that the judge found a link between al-Qaede and 9/11.

Thanks for tracking that down. When an @sshole like this claims that there is a link between Iraq and 9/11, I'd really take what he says with a grain of salt.

Baer said he had concluded that lawyers for the two victims "have shown, albeit barely ... that Iraq provided material support to bin Laden and Al Qaeda."

In a civil court which required a preponderance of the evidence.

Next the Rats will probably say this was a Republican appointee and the legal decision doesn't count.
