COULD SOMEBODY please tell George W. Bush that he is not commander in chief of the judiciary? No matter how ''hot'' he looked in his flight suit, black robes require a cooler demeanor. The administration seems to think that the president has the right to appoint judges the way he can appoint overseers to Iraq. It has forgotten that the Senate is supposed to advise and consent -- and sometimes dissent.

Sorry but this bird brain doesn't have it right yet. The senate is supposed to give each and every candidate an up or down vote. Which they have not done because of obstructionism by a few democrats.

Goodman says that the obligation to provide advice and consent can result in dissent. Obviously, if a vote were held and 51 Senators vote no then the process has met the constitutional requirement. But, here we have no dissent. Rather, we have Senate Democrats denying the fulfillment of the constitutional mandate established in Article II, Section 2, that the Senate deliberate AND vote on judicial nominations. However, in any event, Goodman is wrong. There is no dissent, just obstruction of the Constitution. Something, it appears, Democrats are doing more and more, at the state level (Texas), and at the Federal level.

So I have just one question for Ms. Goodman: Why don't they just vote against the nominees? The reasons don't really matter, just hold the vote....it's only fair.

Why Ellen, you ... Bill Clinton screwed up his first two years by not planning his success because he was stunned that he actually won the darn thing, "Wow, now the babes will be really hot..",, and by having a sophomoric team that screwed up his early cabinet appointments, while his wife babbled on about socializing 1/7th of the economy because there was this BIG crisis then, and while he proposed a gay brigade, (and then lo, even the appointed cabinet choices began getting indicted for this or that).

To compare the rate of judicial successes for a serious as a heart attack presidency like Bush's, to the rate established by the inept but entertaining President Jethro, and to do so in order to abate the constitutional injustice being administered by the sore-headed loser party in obstructing the duly-elected POTUS' choices, while bellyaching that this is happening because THEY are being partisans over THERE, and it's not fair because THEY keep getting elected (by the people, the PEOPLE!) to the executive branch and are therefore stacking the judicial deck in such a way as to roll back decades or unelected edicts from the bench, is to frame the picture such that even the idiot on the hill can claim lucidity.
