Movie Studios Sue Makers of DVD Copying Software

LOS ANGELES (Reuters) - Hollywood's major movie studios on Thursday turned up the legal heat on makers of DVD copying software, squaring off against one company in a California court and suing five others in New York.

In the latest development, lawyers for Paramount Pictures Corp. and Twentieth Century Fox Film Corp. filed for an injunction in U.S. District Court in New York to bar five companies from selling DVD copying software.

The suit names Internet Enterprises Inc., RDestiny LLC, HowtocopyDVDs.com, DVDBackupbuddy.com and DVDSqueeze.com as defendants. None could immediately be reached for comment.

In federal court in San Francisco, lawyers for other film companies argued that the DVD X Copy and DVD Copy Plus software made by St. Louis-based 321 Studios could not be judged to be legal because it violates copyright law.

Both suits center on the same basic issue of whether selling DVD copying software is illegal under 1998's Digital Millennium Copyright Act as the studios claim, or whether it is legal under "fair use" provisions of U.S. copyright law as the companies believe.

Last year, in its preemptory suit, 321 asked a federal judge to rule its software did not violate the DMCA. The studios, under the Motion Picture Association of America, countersued seeking a summary judgment to dismiss the case.

On Thursday, Judge Susan Illston of U.S. District Court for the Northern District of California in San Francisco, heard arguments from attorneys, then adjourned to consider the case, according to both sides. The judge did not say when she might issue a ruling, they said.

BILLIONS AT STAKE

At stake in the cases, the movie studios argue, are potentially billions of dollars in lost future revenues if people can make perfect, digital copies of movies on DVD, then put the movies in digital files stored on the Internet to be distributed around the world, free.

321 claims people have the right to copy DVDs for personal use to make backups in case their DVDs are lost or damaged.

The company, which Moore said has sold some 500,000 versions of its software, has said teachers use it to copy portions of a DVD to use in presentations to classes or seminars. Doing so, 321 believes, falls under the "fair use" provisions of U.S. copyright law.

The studios and the MPAA claim "fair use" isn't the issue because circumventing copy protection is illegal.

"At the end of the day, this is not a lawsuit against consumers or about copyright infringement. It is a lawsuit about a company that traffics in an illegal product," said Russell Frackman, attorney for the MPAA.

The studios involved in the 321 suit are various divisions of Sony Corp. 6758.T , AOL Time Warner Inc. AOL.N , Walt Disney Co.DIS.N , Vivendi Universal EAUG.PA , Metro-Goldwyn-Mayer Inc. MGM.N , Pixar Animation Studios Inc. PIXR.O and Saul Zaentz Co.

Paramount Pictures is a unit of Viacom Inc. VIAb.N, and Twentieth Century Fox is part of the Fox Entertainment Group FOX.N unit of News Corp. Ltd. NCP.AX .

They are Scared of THIS!! Same excuse they had for reel-reel, 8-track recorders, cassette recorders, BetaMax, VHS video, etc etc etc. And it has never hurt them at all.

This suit is likely to fail, because it's perfectly legal to make copies for your own use, so long as you don't rent or sell them or use them for commercial purposes.

Unless, of course, they manage to use their political clout to get a dishonest judgment.

Thay already have the DMCA, which is a deeply dishonest law. No law in this country should be so intrusive as to make illegal something you do in your own home than can harm nobody.

Or, to put it another way, copying is not piracy, and these Hollywood morons are so afraid of piracy, they treat every copy, even those made for perfectly reasonable purposes, as a crime. Now all their customers are criminals, which is, of course, absurd. The backlash is deserved: We should go back to copyright laws of 100 years ago and put The Mouse and all his gang in the public domain.

I have the "DVD-X COPY" and it does work, but they have built in limitations and do ask if you own the movie and put a big banner at the front of each recording with the copyright warning.

321 Studios as far as I can determine does not promote copying copyrighted material. It puts a limit of only 3 copies per each movie (so you can not mass produce them). They have a code that is near impossible to break (never say impossible) for the common joe. It is sorta expensive at $100 bucks, but a nice program if you want to back up your dvd's like I do (to keep the kids from ruining my originals).

I am so sick and tired of these short-sighted greedy bastards.
My husband is a musician who records and mixes on the computer. I am an artist. Needless to say we both work with lots of large files and multiple backups are essential.
We are looking forward to the day when we can afford a DVD burner. In addition to backing up our own work, I am going to make backups of the movies I've bought, because I don't want to risk not having a backup copy of stuff I've invested big $$ in.
They're already making a mint from overpriced CDs (I'm sure we aren't the only people replacing extensive album collections with CDs).

My DVD's are on a high shelf and the kids are not allowed to touch them. When I get a DVD-R I fully intend to make backups fo them for the kids to (ab)use while the masters stay safe.

its $70 now. didn't know about the 3 copy limit. kids tend to handle cd's/dvd's without regard to their cost. i've "wedged" a couple in the drive also. just don't like using the originals; if something bad happens to a "backup", just make another one.

I'm in a business where I'm out of the house for long periods of time, stuck on site, usually with nothing to do for hours at a time. Last year I bought some speakers to go in my laptop bag, and now when I have to upgrade or migrate servers, which has me sitting around for hours at a time, I watch movies. They're movies that I already own, but if the studios think that I'm going to take my $60+ copy of Lord of the Rings Collectors Edition out, on site with me, or my $75 copy of the first season of CSI, they're nuts. I've got far too much invested in my DVDs to bring them out of my house.

I've had a DVD burner for a while now, since many of the files and patches I need (once expanded) will no longer fit on a single CD! So the 4.7GB capacity of a DVD+R is just what I need. Just last week, I needed to have a couple of Ghost image files (for those of you who don't know, Ghost is a program that allows you to "clone" a computer's hard drive). Each image was nearly 2GB! I need a burnable DVD!

DVD-Xcopy works great for me, and it even uses Nero for the actual burning, which is the software I use for burning everything else.

I'm getting tired of being treated like a criminal by these people.
