In a "tolerant" society, there is a huge difference between saying these two things: 1) What consenting adults do in the privacy of their own homes is no business of the government, and, 2) groups, including the Boy Scouts, schools, etc., have good reasons for keeping homosexuals away from positions of trust with young children. Furthermore, the Boy Scouts have a First Amendment "right of association" to make those kinds of practical judgments to protect children in their programs. So says the US Supreme Court. So, it is not the protection of "homosexual rights," but the protection of the recognized Constitutional rights of groups that are under attack.
