Supreme Court Takes CFR Case

At the end of the day today, the US Supreme Court accepted the CFR case (McConnell, et al). The Court will take the case early in its 2003 Term. It will come in a month early, 8 September, for a nearly unprecedented four hour argument.

Briefs by all plaintiffs in the trial court, including Senator McConnell and the NRA, must be filed by 8 July. Defendants below must file by 5 August. Reply briefs must be filed by 21 August.

Thanks for your work on behalf of the Constitution. What more needs to be in the brief than a reading of the First Amendment and where the law violates it?

Well, of course I hope for Rehnquist's good health, but I would note that on this issue he is unpredictable, at best. McCain-Feingold and their allies keep saying they don't want him to retire before this case is heard.

Rehnquist is weak on this issue. The McCainiacs have been freaking out at the idea that he will retire, since they figure any replacement would be worse.

Every time I see "CFR" I think of "Code of Federal Regulations." :)

Hopefully SCOTUS will scrap that too...
