President Bush plans to nominate White House lawyer Brett M. Kavanaugh, an author of independent counsel Kenneth W. Starr's report on President Bill Clinton, for a seat on the U.S. Court of Appeals for the D.C. Circuit, Republican sources said yesterday.
The disclosure came as Bush issued a curt rejection to Democratic senators who had offered to alleviate a fight over a future Supreme Court vacancy by working with him to find a nominee both sides could accept.

This is the proper course. Nominate someone, if the Democrats freak nominate someone more conservative, if the Democrats freak nominate someone more conservative, rinse and repeat as necessary. Pretty soon the Democrats will be up against the wall appearing to obstruct everything. Even they will be smart enough to understand the situation. If they know that the next one will be more conservative every time it will behoove them to shut up and approve nominees.

This is one area Bush has done fairly well in IMO. Judges.

The Dems keep expecting Bush to back down. They lose another fight and then they keep expecting Bush to back down. They lose yet again and they keep expecting Bush to back down.
Hey, didn't we just pass an ADDITIONAL tax cut after the $350 Billion one, to give more money back to low-income families? Is that the 3rd or 4th tax cut in a row?! Afghanistan. Iraq. Partial Birth Abortion Ban. Arming pilots. Killing the Kyoto Global Warming Treaty. Killing the U.S.-CCCP ABM Treaty. Getting the U.S. out of the International Criminal Court.
Hey, I know what! Why don't the Dems push Bush up against the wall on some other issues, expecting *him* to back down on those, too.

My state senator (Valde Garcia - (R) and good guy) among others, are having fits about the obstruction of Estrada(and the other judges).
