Federal judge says he may delay California's Oct 7 recall

(San Jose-AP) -- A federal judge in San Jose says he may decide to postpone California's October recall vote.

US District Judge Jeremy Fogel heard from civil rights groups earlier today. They argued that the quick election is forcing changes in the voting process that require federal approval.

Under the federal Voting Rights Act, any changes in the voting process must be pre-cleared by the Justice Department in places like Monterey County that have a history of low voter turnout.

Fogel set a hearing for August 29th. He suggested he may delay the election at that hearing if federal approval hasn't happened by then.

Also today, Fogel ordered Monterey County not to mail out its overseas ballots until the issues are resolved.

It would be unprecedented for a federal judge to order a delay in a state election. But nothing surprises me about our federal judiciary.

Yah, the Federal Judge does screw us, but the AG's office can help us out.

I sort of expected this. The Dems shopped around for a judge, found one, and got a couple of their outrider groups to bring the lawsuit.

The judge gave the feds two weeks to act. So its not like its the end of the world. Stay tuned...

I posted a thread a couple a days ago about the remaining lawsuits. The only one that caught my attention was the one about 'electors to 100 days to review the ballot'.

What do you know about this? State election law?

If it is, that could be a problem...in conflict with this recall provision.

True to form in the playbook of the RATS. When things don't go their way, the RATS play the race card. I wouldn't be suprised if the 9th Circuit Court of Appeals voids the Recall election.

Davis right now has a lower approval rating among California voters than did Nixon the night before the resignation and some little fool judge in San Jose thinks he's going to stop this freight train? Not bloody likely!!!!!!!!! Off with his head!
