Teen driver should get adult trial, judge rules

The battle over how to prosecute a Gwinnett teen accused of initiating a deadly street race isn't over yet.

Gwinnett Juvenile Court Judge Robert Rodatus announced Monday morning that Wendy Jennings, 16, would be tried as an adult in Gwinnett Superior Court, where penalties can be much stiffer.

By Monday afternoon, Jennings' attorney, Walt Britt, announced his plan to appeal to the state Court of Appeals.

Police say Jennings initiated a street race with another teen on March 7 that caused a fatal wreck, killing her passenger, Jacob Miller, 17. The multiple-car collision also killed Julia Burns, a north Fulton grandmother on her way home from a Florida vacation.

Jennings is charged with first-degree vehicular homicide, reckless driving, racing, failure to maintain her lane and DUI due to smoking marijuana, according to police.

If tried in Juvenile Court, the most she could have faced was up to five years in a juvenile facility. If her case remains in Superior Court, she could face up to a 30-year prison sentence, if convicted on all charges, Gwinnett County District Attorney Danny Porter said. The average prison sentence in Gwinnett for killing one person while driving impaired is about 8 1/2 years, he said.

While lawyers and the appellate court wrestle with Jennings' future, the teen remains at a treatment facility in Minnesota, Porter said. He would not elaborate on what type of treatment she is receiving.

Rodatus had to consider three main factors in deciding the teen's fate -- whether she is amenable to treatment, had committed prior juvenile delinquent acts and the severity of the offense.

Jennings has not been charged with prior driving offenses, Porter said. But neighbors had complained to her parents about seeing her zipping down area streets, Gwinnett police investigator W.A. Newman said.

At the time of the accident, Jennings and Susan Osley, 17, of Atlanta pushed their dueling BMWs beyond 90 mph in a 55 mph zone of bustling Peachtree Parkway, Newman said.

Porter said it could take up to six months to learn whether the appellate court affirms or overturns Rodatus' ruling. That means the case won't make it to trial this year, he said.

Osley, a Greater Atlanta Christian School student, is charged with first-degree vehicular homicide, racing and reckless driving for her role, Porter said. She is automatically treated as an adult due to her age. Her trial date has not been set.

Spoiled as hell.

I think ten years in prison (probably what she'll really do on a 30-year sentence) should be followed up by a life of repentance, trying to do good somewhere in the world to make up for the irreversible destruction she has caused.
Perhaps one day, years from now, we'll hear that she became a nun and devoted her life to helping sick children, or building houses for impoverished elderly people.

Or perhaps not...

You guys have no right to judge her. I know her. She is an AMAZING girl. Ya know what, she screwed up. She killed her boyfriend you know. Can you IMAGINE killing the one you love? Most people I know have BMWs it doesnt mean she is a spoiled girl. Keep your comments about her to yourself, shes having a hard enough time without your judgemental bullshit.

Who's judginh? I'm certainly not. I just said that it's an adult crime, and would be deserving of adult sentencing (if she is, in fact, guilty of a crime).

That being said, I imagine killing the one I love every day. It'a all part of that 'marriage' thing. ;0)

By the way - welcome to FR. Now that I've had my coffee, I can address you more clearly:

Let me get this straight - just because she's a 'good girl' who 'made a mistake' and 'killed the one she loved', we should just overlook the fact that two people are dead because she allegedly wanted to race her car on a public street? I don't know where YOU come from, but where I come from, people are expected to accept responsibility for whatever they do.

She didn't just allegedly kill someone she loved, but she also allegedly was involved in the death of someone she doesn't even know. But hey, she didn't know that person or anything, so they don't count right?

Even good kids screw up - but just because they are "good kids", doesn't mean we shouldn't hold them accountable when they screw up bad.

Oh, no - she's an AMAZING girl. Heck, if she was just a good girl, we might have to give her a ticket or something before sending her home, but AMAZING girls get a group hug and an apology from the families of the victims for having relatives that were crass enough to make her feel bad by getting killed...

I tried really hard to be AMAZING when I was a kid, but I only ever managed to be good, which meant that I only got a free pass to kill one person when I was in high school. Unlike the AMAZING kids, who could do in two if they wanted...

She should not be forced into an adult justice system for making a juvenile desicion. Was she wrong? Definitely, but is she still 16 years old and has her whole life ahead of her? Yes, and that needs to be taken into consideration before anything else.
