Let me get this straight: The 9th Circuit is reexamining the reexamination of the first examination? Am I getting this? The first appeal was to a 3 judge panel. This one is the full court.

What Suffington said. The decision handed down yesterday was made by a three-judge panel that's supposedly chosen at random. From there, the option is to either appeal to the complete court, or SCOTUS.

The ACLU will not get a loaded deck. There will be at least some conservative judges in the en banc hearing, so it won't be a donnybrook for the plaintiffs. Methinks the ACLU crowed too soon.
