Let me get this straight: The 9th Circuit is reexamining the reexamination of the first examination? Am I getting this?

Let me get this straight: The 9th Circuit is reexamining the reexamination of the first examination? Am I getting this?

The first appeal was to a 3 judge panel. This one is the full court.

What Suffington said. The decision handed down yesterday was made by a three-judge panel that's supposedly chosen at random. From there, the option is to either appeal to the complete court, or SCOTUS.

The Circus can decide to rule on its own apparently, a plaintiff is not needed according to FNC.

The ACLU will not get a loaded deck. There will be at least some conservative judges in the en banc hearing, so it won't be a donnybrook for the plaintiffs. Methinks the ACLU crowed too soon.
